The City Attorney expressed
doubt that the traffic hazard along Santa Rita Road constituted an emergency by
State definition.

Mayor Brandes stated he felt this was an emergency situation and favored pro-
ceeding with the project as soon as possible.

Councilmember Butler stated he felt the hazardous condition on Santa Rite Road
was just as critical during the summer as it will be when school starts and should
be dealt with independent of the school problem. He concurred that Council could
determine this to be an emergency situation and should be corrected immediately,.
however, he expressed concern regarding the cost of the project without going out
to bid, and added he felt the project should not be let to contract unless the
total cost was acceptable to the Engineering staff.

Mr. William Kovac, 3124 Weymouth Court, reminded Council of Mrs. Fern Mallard's
concern for the safety of children in this area at the public hearings held regard-
ing the neighborhood shopping center on Santa Rita Road. He stated he felt some
help should be provided to protect the children.

After discussion, it was moved by Councilmember Wood, and seconded by Council-
member Butler, that Resolution No. 79-112, authorizing the City staff to provide
for contract for the Bicycle Path on Santa Rita Road without using the bidding
process due to the immediate danger to the safety of children in the City of
Pleasanton because of elimination of the busing program forcing increased use
of bicycles in an area without provision for bicycle paths, with the total amount
of the bid being acceptable to the Engineering Department, be adopted.
The roll call vote was as follows:
AYES: Councilmen Butler, Kephart, Wood, and Mayor Brandes
NOES: None
ABSENT: Councilman Mercer

Peters Avenue - Building Removal
Mr. Campbell presented his report dated July 3, 1979, regarding this matter.

8. 7/10/79
