It was moved by Councilmember Butler, and seconded by Councilmember Kephart, <br />that Resolution No. 79-113, authorizing City staff to dispose of the house at <br />391 St. }~ry Street by auction, preparatory to completing Peters Avenue from St. <br />}~ry Street to St. John Street, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, Wood, and Mayor Brandes <br />NOES: None <br />ABSENT: Councilman Mercer <br /> <br />Matters for the Information of the Council <br /> <br />1. Draft Condominium Conversion Ordinance <br /> Mr. Harris presented his report dated July 2, 1979, regarding this matter. <br /> <br /> The City Attorney presented a draft condominium conversion ordinance for the <br />information of the Council, and stated this matter would be discussed at the next <br />Council meeting, and to determine whether to extend the moratorium for four addi- <br />tional months or for eight months. He stated the condominium conversion ordinance <br />applies only to existing buildings. <br /> <br /> Mr. Steve Hughes, 3263 Vineyard Avenue, expressed concern regarding the lack <br />of legislation to protect mobile home parks from being converted to other uses. <br />He cited cases from other California cities in support of his concern. <br /> <br /> The City Attorney stated he did not know if the City had power sufficient to <br />regulate mobile home parks but he would research the matter and report back to <br />Council at the first meeting in September. <br /> <br /> Councilmember Butler stated he felt the section of the draft ordinance dealing <br />with standards of construction and safety were most appropriate. He stated that <br />whatever ordinance is adopted by City Council should include strict compliance with <br />the codes and standards. Councilmember Butler stated he was uneasy about the <br />numerical limitations section. <br /> <br /> Councilmember Kephart stated he shared the concerns of Councilmember Butler. <br /> <br /> Mayor Brandes stated he felt this issue should be approached in a different <br />manner - that any condominium conversion would have to comply with the density <br />and restrictions placed on new condominiums being built. He stated standards <br />for new condominiums as well as conversions should be established. <br /> <br /> Councilmember Butler stated that apartment conversion to condominiums usually <br />occurred in older buildings and the building codes would control in this conversion. <br />Councilmember Butler stated he favored limiting the number of apartments. <br /> <br /> After considerable discussion, Council agreed to consider an extension for an <br />additional eight(8) months on the moratorium on conversion of existing multiple <br />family rental dwellings to condominiums as adopted in Ordinance No. 880, at their <br />next meeting, and setting a public hearing for July 24, 1979, regarding this <br />extension. <br /> <br /> The City Attorney advised this item would require a 4/5 vote of the Council to <br />enact it. <br /> <br />2.
