He requested permission to discuss this <br /> matter with Zone 7 Board of Directors Chairman Philcox. Council concurred. <br /> <br /> 3. City Council Agenda Planning Report <br /> Mr. Walker presented the City Council Agenda Planning Report for July, August, <br /> and September. <br /> <br /> REPORTS OF THE CITY ATTORNEY <br /> Upper Lon~view RAP Extension <br /> Mr. Levine presented his report dated July 2, 1979, regarding this matter. <br /> <br /> After discussion, it was moved by Councilmember Wood, and seconded by Council- <br />member Butler, that Resolution No 79-114 authorizing the City Manager to convey <br />to developer the street right-of-way dedicated by Dr. Long for Longview Lane and <br />authorizing the Director of Planning to accept the Special Exemption request for <br />the project if the average lot is 4.97 acres or greater, be adopted. <br />The roll call vote ~Tas as follows: <br />AYES: Councilmen Butler, Kephart, Wood, and ~yor Brandes <br />NOES: None <br />ABSENT: Councilman Mercer <br /> <br />Condemnation Powers Outside the City Limits <br /> Mr. Levine presented his oral report regarding this matter, advising that the <br />power of eminent domain ~s granted by the State, and that only limited powers <br />exist outside the City L~its for the City. Streets and Highways Code Section <br />4092 specifies the City's authority to condemn property for street projects out-' <br />si, de the City when such project is both in and out of the City and ought to be <br />done as one project. In the unincorporated area County approval would be re- <br />quired prior to exercise of condemnation power. <br /> <br />COI.~IJNICATIONS <br /> There were no Communications presented at this meeting. <br /> <br />CITY COUNCIL CALENDAR <br /> Mr. Walker presented the Calendar for the information of the Council. <br /> <br /> Mayor Brandes advised he would be attending the LA~MAmeeting on July ll, 1979, <br />for Councilmember Mercer who is on vacation, and requested Council guidance in <br />voting on a Reclamation Study to be conducted in connection with Phase II of the <br />LAV~MA project. <br /> <br /> After discussion, Council unanimously agreed to support the preparation of a <br />Reclamation Study of Phase II of the LA~~~ Project, in the approximate amount of <br />$7,000.00. <br /> <br />LXECUTIVE SESSION <br /> This item was continued to the City Council meeting of July 24, 1979. <br /> <br />ADJOURNMENT <br /> There being no further business at 9:45 P.M., it was moved by Councilmember <br />Kephart, and seconded by Councilmember Wood, that the meeting be adjourned to meet <br />again in Regular Session on July 24, 1979, 8:00 P.M., Fairgrounds Cafeteria. <br /> <br /> 10. 7/10/79 <br /> <br /> <br />
