It was moved by Councilmember Mohr that the appeal of Interstate Uniform Services <br />Corporation of a decision of the Planning Commission denying their application for a <br />conditional use permit which would allow an addition of 2,500 sq. ft. to the existing <br />nuclear laundry facility at 65 Ray Street, be denied. <br /> <br /> Councilmember Kephart stated there was incomplete evidence to make a decision and <br />that he needed to hear from staff if this is an appropriate land use. <br /> <br /> Mr. Harris stated that staff would not be able to respond to the nuclear issue but <br />could deal with land use. <br /> <br /> Councilmember Butler stated that the land use question is one that should be <br />addressed and he felt the item should be deferred for further staff report. Council- <br />member Butler stated that with regard to his involvement in the nuclear industry, he <br />had made no professional evaluation of the nuclear laundry and did not intend to do <br />so. He stated it was his personal opinion that the maximum amount of radioactivity at <br />that facility insured that the hazard was negligible. Councilmember Butler added he <br />thought the neighbors have a problem with lack of information and in not understanding <br />the situation, and he would like to see that matter addressed also. <br /> <br /> After further discussion, Councilmember Mohr withdrew her motion to deny the <br />appeal of Interstate Uniform Services Corporation. <br /> <br /> It was moved by Councilmember Kephart to direct staff to prepare a recommendation, <br />out of the input received tonight, directed toward the land use aspect. <br /> <br /> The City Attorney advised that the Ordinance Code allows the City Council to make <br />a decision on a matter within 40 days after closing of a public hearing. <br /> <br /> After further discussion, Councilmember Kephart withdrew his motion. <br /> <br /> Mayor Mercer directed staff to prepare a further report and recommendation, and <br />continued the appeal of Interstate Uniform Services Corporation of a decision of the <br />Planning Commission denying their application for a conditional use permit which would <br />allow an addition of 2,500 sq. ft. to the existing nuclear laundry facility at 65 Ray <br />Street, to the meeting of December 23, 1980, 8:00 P.M., at the Fairgrounds Cafeteria, <br />for Council decision. <br /> <br /> Mayor Mercer recessed the meeting at 10:35 P.M. <br /> <br /> Mayor Mercer reconvened the meeting at 10:45 P.M. <br /> <br />Appeal of the City Council to a decision of the Board of Adjustment approving the <br />application of the Southland Corporation for a variance from the requirements of <br />Section 2-9.43(a)~ Article 18~. Chapter 2~ Title II of the Ordinance Code to allow <br />the installation of a free-standing sign at 3760 Hopyard Road on a parcel which <br />is less than three acres in size. The property is zoned C-N (Neighborhood Com- <br />mercial) District <br /> Mr. Harris presented his report (SR 80:358) dated December 2, 1980, regarding <br />this matter. <br /> <br /> Mayor Mercer declared the public hearing open on this item. <br /> <br /> Mr. Joe Keough, 10320 Bubb Road, Cupertino, Real Estate Manager of Southland <br />Corporation, stated he felt this appeal was inappropriate.
