the proximity of the store to other businesses in the area and the poor visibility <br />of the entrance from the street. He stated he felt this is a unique circumstance <br />and that Council could determine findings to approve the variance for a sign. He <br />added that in order for this store to make a profit it is necessary to make the <br />public aware of itslocation. He stated he felt the City Council had an obligation <br />to allow a business an opportunity to succeed but not to guarantee financial gain. <br /> <br /> Ms. Diane Coleman, 3430 Byron Court, franchisee of the 7-Eleven Store, stated <br />she felt the variance requested met the special circumstances for approval, and that <br />the sign would not detract from the area. She added she felt it will be a greater <br />traffic hazard not to have the sign. Ms. Coleman stated that some of the shrubbery <br />could be removed and a low standing sign installed. She stated that the businesses <br />on both sides of the 7-Eleven Store had signs, and she felt this store should be <br />allowed a sign to designate her business as a convenience store. <br /> <br /> No one in the audience spoke in favor of the appeal. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing closed <br />on this item. <br /> <br /> Councilmember Mohr stated she was concerned about the appropriate findings being <br />made to allow this variance. She also expressed concern regarding the confusion of <br />driveways in this area, and suggested some type of street markings be painted to <br />indicate the proper driveway. Councilmember Mohr stated that the free-standing <br />business sign that was originally asked for would be difficult for her to approve <br />but she felt a limited sign would be appropriate. <br /> <br /> After discussion, it was moved by Councilmember Butler, and seconded by Council- <br />member Kephart, that Resolution No. 80-310, denying the appeal of the City Council to <br />a decision of the Board of Adjustment approving the application of the Southland <br />Corporation for a variance from the requirements of Section 2-9.43(a), Article 18, <br />Chapter 2, Title II of the Ordinance Code to allow the installation of a free-stand- <br />ing sign at 3760 Hopyard Road on a parcel which is less than three acres in size, <br />the property being zoned C-N (Neighborhood Commercial) District, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Wood <br /> <br />MATTERS CONTINUED FOR DECISION <br /> There were no matters continued for decision presented at this meeting. <br /> <br />SPECIAL REPORTS <br /> There were no Special Reports presented at this meeting. <br /> <br />REPORTS OF BOARDS AND COMMISSIONS <br /> There were no reports of Boards and Commissions presented at this meeting. <br /> <br />REPORTS OF THE CITY MANAGER <br />Appointment to Alameda County Mosquito Abatement District <br /> Mr. Walker presented his report (SR 80:351) dated December 1, 1980, regarding <br />this matter. <br /> <br /> It was moved by Councilmember Kephart, and seconded by Councilmember Butler, <br />that Resolution No. 80-311, reappointing John Vizzolini as a trustee on the Alameda <br />County Mosquito Abatement District for a two year term ending January 2, 1983, be <br />adopted. <br /> <br /> 9. 12/9/80 <br /> <br /> <br />
