the proximity of the store to other businesses in the area and the poor visibility of the entrance from the street. He stated he felt this is a unique circumstance and that Council could determine findings to approve the variance for a sign. He added that in order for this store to make a profit it is necessary to make the public aware of itslocation. He stated he felt the City Council had an obligation to allow a business an opportunity to succeed but not to guarantee financial gain. Ms. Diane Coleman, 3430 Byron Court, franchisee of the 7-Eleven Store, stated she felt the variance requested met the special circumstances for approval, and that the sign would not detract from the area. She added she felt it will be a greater traffic hazard not to have the sign. Ms. Coleman stated that some of the shrubbery could be removed and a low standing sign installed. She stated that the businesses on both sides of the 7-Eleven Store had signs, and she felt this store should be allowed a sign to designate her business as a convenience store. No one in the audience spoke in favor of the appeal. There being no further testimony, Mayor Mercer declared the public hearing closed on this item. Councilmember Mohr stated she was concerned about the appropriate findings being made to allow this variance. She also expressed concern regarding the confusion of driveways in this area, and suggested some type of street markings be painted to indicate the proper driveway. Councilmember Mohr stated that the free-standing business sign that was originally asked for would be difficult for her to approve but she felt a limited sign would be appropriate. After discussion, it was moved by Councilmember Butler, and seconded by Council- member Kephart, that Resolution No. 80-310, denying the appeal of the City Council to a decision of the Board of Adjustment approving the application of the Southland Corporation for a variance from the requirements of Section 2-9.43(a), Article 18, Chapter 2, Title II of the Ordinance Code to allow the installation of a free-stand- ing sign at 3760 Hopyard Road on a parcel which is less than three acres in size, the property being zoned C-N (Neighborhood Commercial) District, be adopted. It was moved by Councilmember Kephart, and seconded by Councilmember Butler, that Resolution No. 80-311, reappointing John Vizzolini as a trustee on the Alameda County Mosquito Abatement District for a two year term ending January 2, 1983, be adopted. 9. 12/9/80
