Mr. Bob Graham, owner of business at 614 Main Street, representing the Downtown
<br />Merchants Association, addressed the problem of what happens outside of card rooms.
<br />He stated his customers had been verbally assaulted, that there had been vandalism,
<br />and litter problems, which adversely affected all businesses in the downtown area.
<br />Mr. Graham stated he was not opposed to card rooms but was against the problems
<br />associated with this business.
<br />
<br /> Ms. Alice Watson, 514 Bonita, representing the Downtown Merchants Association,
<br />presented a draft signed by 82 residents and business persons which read as follows:
<br />
<br /> "We, the undersigned Downtown Merchants and interested citizens of the
<br /> City of Pleasanton, do hereby request the City Council, its Commis-
<br /> sions, the administrative officers and employees, as follows: (1) To
<br /> review the present zoning and land use ordinances and to suggest amend-
<br /> ments to upgrade the Main Street shopping area and avoid the problems
<br /> of the present mixture of commercial uses; and (2) To enforce the
<br /> health, safety, building, and occupance regulations to enhance the
<br /> atmosphere for shoppers".

<br /> Mr. Bill Hirst, 147 Bernal Avenue, Attorney representing the owner of the Pastime
<br />Pool Hall, stated his client favored Alternate No. 1 or Alternate No. 2a of the staff
<br />report, but was opposed to Alternates 2b and 2c.. Mr. Hirst presented a petition
<br />signed by 79 residents which read as follows:
<br />
<br /> "We, the undersigned, support indefinite retention of the card room
<br /> permit for the Pastime Pool Room so as to preserve this harmless
<br /> and enjoyable form of social intercourse and recreation".
<br />
<br /> Mr. Hirst stated that the Pastime Pool Room has conducted an orderly business
<br />and is in conformity with the permit, therefore should be entitled to favorable con-
<br />sideration.
<br />
<br /> Councilmember Kephart stated he would go along with this ordinance reluctantly,
<br />and asked that card room activities be closely monitored for compliance with all
<br />City codes.
<br />
<br /> It was moved by Mayor Mercer, and seconded by Councilmember Butler, that Ordi-
<br />nance No. 953, to be read by title only and waiving further reading thereof, amending
<br />Title IV (Health, Safety, Moral and General Welfare), Chapter 2 (Special Permits),
<br />Article 7 (Card Rooms), regarding number of permits (leaving the ordinance in essen-
<br />tially the same format requiring yearly reapplication by the permit holder but making
<br />no determination with regard to the future of card rooms), be introduced.
<br />The roll call vote was as follows:
<br />AYES: Councilmembers Butler, Kephart, Mohr, and Mayor Mercer

<br />ABSENT: Councilmember Wood

<br />Denial of Claim for Gerald and Barbara Ford
<br /> Mr. Levine presented his report (SR 80:349) dated November 25, 1980, regarding
<br />this matter.
<br />
<br /> It was moved by Councilmember Butler, and seconded by Councilmember Kephart, that
<br />Resolution No. 80-314, denying the claim of Gerald and Barbara Ford in the amount of
<br />$25,000 per claim, claiming false arrest and imprisonment, be adopted.
<br />The roll call vote was as follows:
