approving V-80-20, application of the Southland Corporation for a variance from the <br />requirements of Section 2-9.43(a), Article 18, Chapter 2, Title II of the Ordinance <br />Code to allow the installation of a free-standing sign at 3760 Hopyard Road on a <br />parcel which is less than three acres in size. <br /> <br />REPORTS OF THE CITY MANAGER <br />~roposed Annexation of approxtmatel~ 43 acres on Foothill Road <br /> Mr. Warnick presented his report (SR 80:322) dated November 10, 1980, regarding <br /> this matter. <br /> <br /> Mr. Burke Critchfield, Attorney representing the applicant, presented a brief <br />background of the subject property. He stated that he disagreed with the staff <br />report relative to the four points contained therein listing reasons why staff <br />does not feel this annexation would be advantageous to the City at this time. Mr. <br />Critchfield asked for approval of the annexation proceedings. He stated his client <br />will ask for PUD zoning on the property and that he already has 12 sewer permits <br />allocated for this property. <br /> <br /> Councilmember Mohr expressed concern regarding the possible use of septic tanks <br />and added that she concurred with staff recommendations for disapproval of the <br />annexation. <br /> <br /> Mayor Mercer stated that annexation of this unique piece of property would allow <br />the City to control its development and he did not feel it would be setting a pre- <br />cedent. Councilmembers Kephart and Butler concurred. <br /> <br /> It was moved by Councilmember Kephart, and seconded by Councilmember Butler, <br />that Resolution No. 80-288, to initiate annexation proceedings with LAFCO on the <br />approximately 43 acres on Foothill Road located between Foothill Road and 1-680, <br />approximately 800 feet south of Muirwood Drive, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, and Mayor Mercer <br />NOES: Councilmembers Mohr and Wood <br />ABS~'NT: None <br /> <br />Adoption of Flood Damage Prevention Ordinance~ National Flood Insurance Program <br /> Mr. Warnick presented his report (SR 80:326) dated November 12, 1980, regarding <br />this matter. <br /> <br /> It was moved by Councilmember Wood, and seconded by Councilmember Butler, that <br />Ordinance No. 949, relating to Flood Damage Prevention, be read by title only and <br />waive further reading thereof. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABS~T: None <br /> <br /> After discussion, it was moved by Councilmember Wood, and seconded by Council- <br />member Mohr, that Ordinance No. 949, amending Title II (Zoning and Development) by <br />adding Chapter 14 relating to Flood Damage Prevention, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> 5. ll/17/SO <br /> <br /> <br />
