Adoption of Resolution No. 80-231, a resolution of the City Council of Pleasanton, California, taking the position that the matter of the peripheral canal should be put on the ballot for public consideration; and in the event its ballot recommen- dation is not acted upon, expressing its desire to go on record as being opposed to the peripheral canal. The roll call vote was as follows: AYES: Councilmembers Butler, Kephart, Mohr, and Mayor Mercer NOES: None ABSENT: Councilmember Wood MATTERS INITIATED BY COUNCILMEMBERS Councilmember Kephart stated that the Par Cours at the Amador Valley Community Park is continually being valdalized. He requested that there be increase patrol checks in this area and especially on the side near the Safeway Shopping Center. Councilmember Kephart, in regard to gravel truck spillage, read Section 21113(a) of the Vehicle Code relating to removal of material from the highway. He emphasized that the Code states that material must be "immediately" removed. The City Attorney advised that this Section had been reviewed and stated that the problem of enforcement is that a police officer must actually see the spillage happen to be able to cite a gravel truck for this violation. Councilmember Kephart stated he would like to ha~e stricted enforcement of this section of the Code. 2. 9/16/80
