Mr. J. Bartlett, 2292 Crestline Road, stated he felt that allowing this variance <br />would set a precedent and that also it would make a poor aesthetic impact. <br /> <br /> Mrs. Liz Schiano rebutted the opponents by stating the fence was needed to en- <br />close the property, lessen noise and reduce the litter problem. She stated she did <br />not feel that corner lots should be penalized by not allowing a variance to the <br />setback requirements. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing closed. <br /> <br /> After discussion, it was moved by Councilmember Wood, and seconded by Council- <br />member Butler, that Resolution No. 80-188, denying the appeal of Michael J. Schiano <br />of a decision of the Board of Adjustment denying his application for a variance to <br />allow the construction of a six foot high fence which would encroach into the re- <br />quired setback of the property located at 5292 Hummingbird Road, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart,' Mohr, and Wood <br />NOES: Mayor Mercer <br />ABSENT: None <br /> <br />Application of Golden Gate Rac~uetball Courts. for development plan approval of a <br />33~9¥q' sq. ft. racquetball fa'ciikty. on a 1.23 acre site at""Old Hopyard R~ad" just <br />south of 1-580. Zonin~ .for the property is PUD (Planned Unit Development) District <br /> <br />On the basis of an Initial Study of the potential environmental impacts of the .pro- <br />ject~.. the Director of Plannin8 and.~ommunit7 Development has determined that the <br />proposed pr0~ect would not have an~ potential significant adverse effects on the <br />environment and that an environmental impa.c..t repor.t. need not be prepared. This <br />Initial .Study is available for review at the Plannin~ D~yision~ 200 Bernal Avenues. <br />Pleasanton. Comments On this.deci. sionmay be directed to either the Plannin~ staff <br />prior to the above meetin8 date, or di.req. tl~ to the City Council at the above <br />noticed meetin~ <br /> Mr. Harris presented his report dated July 15, 1980, regarding this matter. <br /> <br /> Mayor Mercer declared the public hearing open on the application and the nega- <br />tive declaration. <br /> <br /> No one in the audience spoke in favor of or in opposition to this item. <br /> <br /> Mayor Mercer declared the public hearing closed on the application and the <br />negative declaration. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Mohr, that <br />Resolution No. 80-189, determining on the basis of a review of initial environmental <br />study done for this project, that no significant environmental impact would occur as <br />outlined in the City's guidelines and that a Negative Declaration is appropriate for <br />development plan approval of a 33,920 sq. ft. racquetball facility on a 1.23 acre <br />site at "Old Hopyard Road" just south of 1-580, zoning for the property is PUD <br />(Planned Unit Development) District, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, and Mayor Mercer <br />NOES: Councilmembers Kephart and Wood <br />ABSENT: None <br /> <br /> Councilmember Kephart stated he felt this proposed development is an extension <br />of mistakes made in the past in this area; that this project will create a parking <br />problem and that the design is not appealing. <br /> <br /> 6, 7/22/80 <br /> <br /> <br />
