Ms. Chang's amendment, while not going as far as the <br />City's requested condition, would have set a useful precedent by combining a police <br />power regulation with reference to E1 Charro Road. Councilmember Mohr stated she was <br />disappointed when the Commission voted 4 to 3 in favor of the amendment, but since <br />the commission needed a vote of 5 in favor, the motion failed. A subsequent motion <br />without Ms. Chang's condition was passed by a vote of 5 to 2, Commissioners Chang and <br />Nickolls dissenting. At the conclusion of the hearing, the Commissioners passed a <br />resolution requesting the Board of Supervisors to consider the issues of impacts on <br />neighboring property owners due to gravel traffic and to consider the time limits <br />proposed. After discussion, it was moved by Councilmember Mohr, and seconded by <br />Mayor Mercer, that the City appeal the issuance of Permit Q-53 to the Board of Super- <br />visors and request the Board of Supervisors to approve a condition relating to gravel <br />truck use of First Street and time limitations, and directing staff to file the <br />appeal with the Board of Supervisors. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mob. r, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> Cit ' <br /> Mayor Mercer designated Councilmember Mohr as the y s representative at the <br />Board of Supervisors meeting to speak on =his appeal. <br /> <br /> Mayor Mercer advised that he had been appointed by the Mayors' Conference as an <br />alternate member on LAFCO, and will be attending all LAFCO meetings. <br /> <br />MEETING OPEN TO THE PUBLIC <br /> Assemblyman Floyd Mori addressed the Council regarding 1-580 diamond lanes and <br />potential resolution of the problems. He stated that information received in a <br />recent report from Celttans, requested at the last meeting with them, revealed a <br />safety implication on buffer lanes. He advised that state and federal reports show <br />that carpool lanes resulted in increased traffic accidents and stated that this <br />factor may be a basis for a lawsuit. He added that all traffic reports conclude <br />that diamond lanes tend to have a higher potential for accidents, and did not <br />impact adversely on the environment. Assemblyman Mori presented 'a packet of infor- <br />mation to the Council to be used for possible legal action to eliminate the diamond <br />lanes on 1-580.
