Mrs. Mohr stated that ROAR would have a formal written response for presentation <br />at the fiual public hearing on this matter. <br /> <br /> Mr. Jack Heck, representing Kaiser Sand and'Gravel, stated he had received and <br />reviewed the draft E.I.R., and he felt there were some significant omissions and <br />inaccuracies in the report. He advised he would respond in writing to these matters <br />before the due date. <br /> <br /> There being no further testimony, Mayor Brandes declared =he public hearing <br />closed. He urged anyone having any additional comments to respond in writing <br />before April 2, 1980. <br /> <br /> After discussion, Council scheduled April 29, 1980, 8:00 P.M.,. Fairgrounds <br />Cafeteria, for the public hearing on the final Environmental Impact Report for <br />the proposed ordinance to regulate the use of streets for gravel trucks in <br />Pleasanton. <br /> <br /> Mayor Brandes thanked the audience for their attendance and comments on this <br />item. <br /> <br />MATTERS CONTINUED FOR DECISION <br /> There were no matters continued for decision presented at this meeting. <br /> <br />SPECIAL REPORTS <br />Contract with Pleasanton Cultural Arts Council for Cultural Arts Building Land <br /> Mr. Levine presented his report dated March 6, 1980, regarding this matter. <br /> <br /> Councilmember Mercer asked if there was enough land available for thi~. proposed <br />butldin~ as well as the proposed Police facility on the remaining five acres of <br />Civic Center property. Mr. Walker advised there was sufficient land for both build- <br />ings. <br /> <br /> Mr. Martin Inderbitzen, Attorney representing Pleasanton Cultural Arts Council, <br />stated this group concurred with the agreement but felt two additional items should <br />be included. He stated there was concern regarding sewer capacity; that this grou~ <br />did not want to go through fund-raising projects and planning only to find out later <br />there was no sewer capacity. Therefore, they requested that an appropriate amount <br />of sewer capacity be reserved for the proposed project. Mr. Inderbitzen stated the <br />second concern of PCAC was for adequate parking space and he requested that a recip- <br />rocal parking agreement be entered into to assure ample parking for the' proposed <br />project. <br /> <br /> Mr. Levine advised that both of these requests were reasonable. He stated that <br />a clause relating to reservation of adequate sewer capacity could be added to the <br />agreement. He stated he felt a reciprocal parking agreement was premature at this <br />time and should be considered at the time that detailed plans are approved, and that <br />this could be added to the ground lease agreement. <br /> <br /> Mr. Inderbitzen agreed to the recommendations of the City Attorney. He thanked <br />the City Council and City staff for their cooperation in this matter. <br /> <br /> After discussion, it was moved by Councilmember Butler;,and seconded by Council- <br />member Wood, that Resolution No. 80-57, approving the Agreement and Ground Lease <br />Agreement with Pleasanton Cultural Arts Council, as amended relative to reserving <br />adequate sewer capacity and further consideration of a reciprocal parking agreement, <br />teldelve to use of land at the Civic Center site for a Cultural Arts building, be <br />adopted. <br /> <br /> <br />
