The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, Mercer, Wood, and Mayor Brandes <br />NOES: None <br />ABSENT: None <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Wood, that <br />Ordinance No. 924, to be read by title only and waiving further reading thereof, <br />approving the application of John and Joan Caroline to rezone the 69 acres located <br />on the south side of Valley Avenue and immediately easterly of the residences along <br />Kolln Street from the I-P (Public and Institutional) District to the PUD-Industrial <br />(Planned Unit Development-Industrial) District and for development plan approval <br />for a business/industrial park complex, subject to conditions established by the <br />Planning Commission with Condition 7 being amended to read "That trucks (of all <br />sizes) making pick-ups and deliveries shall be allowed to service the subject <br />property only between the hours of 7:30 a.m. and 5:30 p.m.", and Condition 9 being <br />amended to read "That the developer enter into an agreement with the City approved <br />by the City Attorney agreeing to participate in an assessment district for the <br />improvement and/or purchase of E1 Charro Road and to agree to use E1 Charro Road <br />exclusively for all truck traffic entering or leaving Pleasanton generated by the <br />subject property when that road becomes available for such use", and moving the <br />recreation area to the northeast corner of the park complex, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, Mercer, Wood, and Mayor Brandes <br />NOES: None <br />ABSENT: None <br /> <br /> The City Attorney advised the second reading and adoption of this ordinance <br />is scheduled for the City Council meeting of January 22, 1980. <br /> <br />Application of Pleasanton Surfer.~ Cent.er to rezone a 27~135 sq. ft. pa.r.cel of land <br />located imm. e.diat. el7 behind the L~nnewood Methodist Church at 4444 Black Avenue from <br />the "P" (Public and Institutional) District to the"O" (Office) District. A nega- <br />tive declaration of environmental impacts will also be considered <br /> Mr. Harris presented his report dated January 2, 1980, regarding this matter. <br /> <br /> Mayor Brandes declared the public hearing open on the application and the <br />Negative Declaration. <br /> <br /> Mr. Jack Bras, Architect representing the applicant, stated he concurred with <br />the staff report and that the Planning Commission had recommended approval of this <br />application, therefore, he requested Council approval of this item. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> There being no further testimony, Mayor Brandes declared the public hearing <br />closed on the application and the Negative Declaration. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Butler, that <br />Resolution No. 80-13, determining on the basis of a review of initial environmental <br />study done for this project, that no significant environmental impact~ would occur as <br />outlined in the City's guidelines and that a Negative Declaration is appropriate to <br />rezone a 27,135 sq. ft. parcel of land located immediately behind the Lynnewood <br />Methodist Church at 4444 Black Avenue from the "P" (Public and Institutional) Dis- <br />trict to the "O" (Office) District, be adopted. <br /> <br /> 8. 1/s/so <br /> <br /> <br />
