After discussion, it was moved by Councilmember Wood, and seconded by Council- <br />member Kephart, that Resolution No. 80-11, denying the appeal of Richard Conklin <br />from the denial of a home occupation permit at 6268 Robin Court for a firearm ammu- <br />nition reloading service based upon the determination of the Building Official that <br />such use of a residence would be in violation of the provisions of the Uniform Build- <br />ing and Fire Codes as incorporated in Chapter 3, Title II, and Chapter 1, Title IV, <br />respectively, of the Ordinance Code of the City of Pleasanton, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, Mercer, Wood, and Mayor Brandes <br />NOES: None <br />ABSENT: None <br /> <br />Application of John and Joan Caroline to rezone the 69 acres located on the south <br />side of Valley Avenue and immediately east. erly of the residences along KQlln Street <br />from the IiP ~PUbliC and Institutional) District to the PUD-Industrial (Planned <br />Unit Development-Industrial) District and for develop.ment plan approval for a <br />business/industrial park complex. An environmental impact report (EIR) will also <br />be considered <br /> Mr. Harris presented his staff report dated January 2, 1980, regarding this <br />matter. <br /> <br /> b~yor Brandes declared the public hearing open on the application and the EIR. <br /> <br /> Mr. John Caroline, 4487 Pleasanton Avenue, applicant, presented composite <br />pictures showing the proposed commercial development. He stated he concurred <br />with the conditions established by the Planning Commission and with the Environ- <br />mental Impact Report. He stated he felt the traffic figures in the EIR were high <br />and he presented graphs completed by a traffic engineer showing lower truck and <br />vehicle traffic counts which he felt were more reasonable. <br /> <br /> Councilmember Mercer asked Mr. Caroline how the restriction to only allow 2- <br />axle trucks into the development would relate to his businesses. Mr. Caroline <br />stated his tenants feel they can comply with this condition without any problems. <br /> <br /> Mr. Lars Jotten, 1265 Kolln Street, representing the residents on Kolln Street, <br />stated the majority of homeowners were in general agreement with the proposed plans <br />and conditions as outlined in the staff report. However, this group would like to <br />have the recreation facility moved from the northwest corner to the northeast corner <br />of the development. Mr. Jotten stated the residents were also concerned about the <br />allowable business hours of the park complex and suggested the hours be restricted <br />to 7:00 a.m.-5:30 p.m. <br /> <br /> The following persons spoke in opposition to this item: <br /> <br /> Mr. Robert Pearson, 3590 Churchill Court, addressed the following three areas <br />of concern: (1) land use; (2) traffic; and (3) sewerage capacity. He elaborated <br />extensively on each item stating he felt it was imperative to know what uses were <br />proposed for the industrial park before any approvals were given in order to deter- <br />mine if the uses were compatible with the neighborhood. He added the uses would <br />also determine whether or not the development would be in conformance with the <br />General Plan. Mr. Pearson stated he disagreed with the traffic figures presented <br />by Mr. Caroline. He expressed concern regarding the problem of access and stated <br />he also felt no approvals should be given until such time as E1 Charro Road is <br />open for public use.
