MEETING OPEN TO THE PUBLIC <br /> Mrs. Judy Mayhew, 5584 San Jose Drive, expressed support for Council's position <br />relative to the opening of E1 Charro Road. She inquired as to when the Environmental <br />Impact Report on First Street truck traffic would be before the City Council. The <br />City ,Manager advised that the draft Environmental Impact Report should be available <br />within the next two weeks, will have a 45 day circulation period, and is expected to <br />be before Council the end of February. <br /> <br />PUBLIC HEARINGS <br />Appeal of Thomas Jor~ensen of a decision of the Plannin~ Commission d.epy~n~ Case. <br />RZ-79-13~ an application to rezone a 0.7 acre site ~pcat.ed .a~ 4.22.5 St.anle7. B°ule' <br />yard from the R-1-6500 (Single,Family Residential) District to the C-S (Commercia~ <br />Services) District <br /> (Continued Open f.rom 1.0.9-7.9, 11-1~1~7.7~', and il-27'79) .... <br /> Mayor Brandes declared the public hearing closed on this item and the matter <br />dismissed from the agenda per the written request of the Attorney for the applicant <br />dated January 2, 1980. <br /> <br />Appeal of Richard Conklin from the denial of a home .occupation permit at 6268 Robin <br />Court for a firearm ammunition retoadin~ service based upon the determination of <br />the Buitdin~ Official that such use of a residence would be in violation of the <br />provisions of the Uniform Building and Fire Codes as incorporated in Chapt. er_3.~ <br />Tj.t!e !.I~ and Chapter 1~ Title ~V~ .respectively~ of the Ordinance Code of the CitX <br />of Pleasanton <br /> Mr. Bro~?n stated that staff was concerned that in approving a home occupation <br />~ermit to commercially retoad small arms ammunition they would be sanctioning such <br />an activity and in case of fire or safety problems the City could be held liable. <br />Mr. Brown also advised that the fire department would not get in close proximity <br />zo a structural fire where it was known there were explosives inside, and that this <br />is standard procedure. <br /> <br /> >fr. Cullum presented his report dated January 3, 1980, regarding this matter. <br /> Mayor Brandes declared the public hearing open. <br /> <br /> Mr. Richard Conklin, 6268 Robin Court, appellant, stated that he began reloading <br />fire arms as a hobby for himself but had been requested by friends to reload ammuni- <br />zion for them. He stated that he would have to charge them for the materials. He <br />advised-that he had applied for and received a Federal Firearms Permit. He stated <br />he then applied for a business license with the City for income tax purposes, and <br />had been denied this permit under the Home Occupation Permit use. Mr. Conklin <br />stated he did not intend to start a business but would be doing this service on a <br />s~a!l scale for friends. He stated he would not be keeping any more smokeless <br />po~er or primer on hand than he would for his own hobby, He advised these materials <br />would be kept in a metal box with an oak lining which would take 8 hours to burn <br />through, and that smokeless power is not explosive. Mr. Conklin stated he would <br />not be increasing the hazard over and above the amount he has on hand in supply for <br />his hobby. He added he did not feel there was any reason for concern regarding <br />this request. <br /> <br /> Mr. Roy Silcox, 6267 Roslin Court, spoke in opposition to this item, expressing <br />his concern that Mr. Conklin could enlarge his service without anyone knowing about <br />it. <br /> <br /> There being no further testimony, Mayor Brandes declared the public hearing <br />closed. <br /> <br /> 4. 1/8/80 <br /> <br /> <br />
