373 <br /> <br /> After discussion, it was moved by Councilmember Mohr, and seconded by Council- <br />member Kephart, that Resolution No. 81-203, approving the appeal of Cecile Lemson <br />and Marijke Spilman of a decision of the Planning Commission denying a conditional <br />use permit to allow massage services in conjunction with a beauty salon located at' <br />3506-A Old Santa Rita Road, subject to the following two conditions: (1) that no more <br />than one masseuse be employed on the premises; and (2) that the applicant apply for <br />and receive all required permits from the Pleasanton Police Department for a massage <br />service, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Butler <br /> <br />Appeal of. Zoning for the <br />propeTty is RM-15'0~ ~.ulti-fa~tly residential District) .... <br /> Mr. Harris presented hi~"r'~port (SR 81:204) dated June 12, 1981, r'eg~rdi~ ~s <br />matter. <br /> <br /> Mayor Mercer declared the public hearing open. <br /> <br /> Mr. Mert Murray, appellant, representing FMP.Associates, explained the setback <br />from the street, and stated the variance is needed in order to allow for a larger <br />patio and front yard area and that it would be no closer to the street than other <br />townhouse developments in the area. <br /> <br /> Mr. John Pietronave, partner with FMPAssociates, stated that a five foot fence <br />is necessary for privacy and that anything less would probably be added onto by the <br />owner.
