375 <br /> <br /> · Mayor Mercer advised there will be a public hearing by the Alameda County Plan- <br />ning Department on July 6, 1981, to consider an alternate truck route on Dublin <br />Canyon Road for the proposed Moller quarry on Foothill Road. Mayor Mercer stated <br />he had received several calls from residents in the area in opposition to the <br />alternate route. After discussion, it was moved by Mayor Mercer, and seconded by <br />Councilmember Kephart, that Resolution No. 81-202, stating the City Council's <br />opposition to an alternate route on Dublin Canyon Road for the proposed Moller <br />quarry project on Foothill Road, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Butler <br /> <br /> Mayor Mercer stated he had received a request from the Pleasanton Lions Club, <br />asking that the Wayside Park Band Stand be dedicated in memory of Chan Henderson. <br />Council supported this dedication in honor of Chan Henderson. <br /> <br />CITY COUNCIL COMMITTEE REPORTS <br /> There were no City CounCil Committee Reports presented at this meeting. <br /> <br />MEETING OPEN TO THE PUBLIC <br /> Ms. Mary Blanchard, 3966 Churchill Drive, representing Pleasanton Meadows Home- <br /> rou ' <br />owners Association, stated it was this g p s understanding.that at the last City <br />Council meeting a general plan amendment was approved which would realign a frontage <br />road on Old Santa Rite Road that would create an intersection behind homes in this <br />area. Mayor Mercer stated that a realignment of the frontage road on Old Santa Rita <br />Road had been approved but the exact location and design had not been approved and <br />that an agreement had been signed that would not allow development of the area <br />through which such a road would go for 18 months. <br /> <br /> PUBLIC HEARINGS <br />Appeal of Cecile Lemson and Marijke Spilman .of a decision of the Plannin~.Comm. ission <br />denying a conditional use permit to allow massage services in.cqnj. unction With a <br />beauty salgn located at 3506-A Old Santa Rite Road <br /> Mr. Harris presented his report (SR 81:202) dated June 12, 1981, regarding this <br />matter. <br /> <br /> Mayor Mercer declared the public hearing open. <br /> <br /> Mr. Paul Bernhart, Attorney representing the appellants, suggested that the City <br />could not legally prohibit therapeutic massage services to both female and male cus- <br />tomers in connection with a beauty salon business. The City Attorney concurred. <br />Mr. Bernfmrt stated that this beauty salon planned a full range of services, includ- <br />ing therapeutic massage and later a spa, and stated his clients were in agreement <br />with the first. two conditions imposed by the Planning Commission for approval of <br />this application~ but were opposed to the condition excluding males from massage services <br /> <br /> Mr. Oliver Anjo, 2403 Raven Road, stated he opposed massage services in Pleasan- <br /> ton as he felt it will create many problems. He urged Council to deny the appeal. <br /> <br /> Mr. Bernhart stated the beauty salon is not a massage parlor but rather a busi- <br />ness offering therapeutic massage in its services. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br /> closed. <br /> <br /> Councilmember stated that this business would be closely watched to insure there <br /> is no change in its type of use. <br /> <br /> 3. 6/23/81 <br /> <br /> <br />
