Amaral to change .the..Gene~al Plan land use designation of a <br /> 0.27 acre lot located at 404 St. Mary Street from "High Density Residential" to <br /> "Commercial and Offices" <br /> On the basis of an Initial Study of the potential, environmental impacts of the <br /> ~ro~eqt, the Director of Planning and Cqmmunity Development has determined that ' <br /> the proposed project would not have any potential siMnificant adverse effects on <br /> the environment and that an environmental impact report need not be~prepared. <br /> This Initial Study is available for review at the Planning...Division~ 200 Bernal <br /> Avenue~ Pleasant~n. Comments on this decision may. be directed either t0..the <br /> Plannin~ Staff prior to the above meetin~ .or directly t~ .the City COuncil at the <br /> .above noticed meeting ....... <br /> <br /> Mr. Harris presented his report (SR 81:179) dated June 1, 1981, regarding this <br /> matter. <br /> <br /> council received ~-ritten opposition to ·this application from the following <br /> persons-: <br /> <br /> Dorothy Bronner, 426 Division Street <br /> The Netton Family, 462 St. Mary Street <br /> <br /> Mayor Mercer declared the public hearing open on the application and the nega- <br /> tive declaration. <br /> <br /> Mr. Lee ~m~raI, owner of the property, presented drawings of possible one story <br /> building concepts that could be constructed on this parcel, all of which he felt <br /> would be compatible with the surrounding residential neighborhood. He stated that <br /> an office building would not create as many problems as High Density residential <br /> development. He stated that local realtors feel that Office zoning would be better <br /> zoning and that it would enhance the use of Peters Avenue. Mr. Amaral stated that <br /> he intended to occupy a portion of the proposed building for his own office use and <br /> already had a tenant for the remaining portion. <br /> <br /> The following persons spoke in opposition to the application: <br /> <br /> Mr. Roger Netton, 462 St. Mary Street, speaking on behalf of his parents, stated <br /> they felt this area should remain residential to be aesthetically compatible with <br /> the neighborhood. <br /> <br /> Ms. Alice Mohr, 431 St. Mary street, stated she would feel more secure with <br /> residential development around her. She stated she felt that Office development <br /> would create spot zoning and set a precedent. She added she did not want commer- <br /> cial development in this area. and would object to 9:00 a.m. to 5:00 p.m., type <br /> occupancy. <br /> <br /> Mr. Amaral rebutted by stating the proposed building would blend in with the <br /> surrounding area. He stated he felt that further study of this area would be a <br /> waste of time and money. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />.-_ closed on the application and the negative declaration. <br /> <br /> After discussion, it was moved by Councilmember Wood, and seconded by Council= <br /> member Kephart, to deny the application of Lee J. Amaral to change the General Plan <br /> land use designation of a 0.27 acre lot located at 404 St. Mary Street from "High <br /> 'Density Residential" to "Commercial and Offices". <br /> <br /> 17. 6/9/81 <br /> <br /> <br />
