363 <br /> <br /> Mayor Mercer presented five new bills relative to housing and land use, to the <br />City Attorney for review and comment if deemed necessary. <br /> <br />CITY COUNCIL COMMITTEE REPORTS <br /> Councilmembers presented various Committee Reports for the information of the <br />Council. <br /> <br />MEETING OPEN TO THE PUBLIC <br /> No one in the audience addressed the Chair. <br /> <br />PUBLIC HEARINGS <br /> There were no Public Hearings presented at this meeting. <br /> <br />MATTERS CONTINUED FOR DECISION <br />Consideration of Ordinance amendin8 Title II~ Chapter 1,.by adding Article 13 <br />(Condominium, Townhouse and Stock Cooperative Conversions) <br /> Mr. Levine presented his report (SR 81:167) dated May 21, 1981, regarding this <br />matter. <br /> <br /> Mr. Marshall Perry, Modesto, owner of Vista Del Sol Apartments, stated he was <br />opposed to this type of regulation of free enterprise and felt there should be <br />policy guidelines instead. He stated if Council does adopt a condominium conver- <br />sion ordinance that it should be fair and equitable for everyone involved. Mr. <br />Perry stated that condomtnium conversion would add to the City's gross tax revenue. <br />He stated that it would also make affordable housing available to those who might not <br />otherwise be able to own their own home. Mr. Perry urged that the moratorium be <br />lifted. He thanked the Council and staff for their cooperation with him in this <br />matter. <br /> <br /> Council reviewed the draft ordinance and made the following changes: <br /> <br /> In Section 2-25.09 .Physical Standards (b) - add a sentence "Only applies to <br />non-exempt projects". <br /> <br /> After discussion, it was moved by Councilmember M0hr, and seconded by Council- <br />member Wood, to delete the work "NOT" in Section 2-25.06 Approval Procedures (6)(c) <br />which states - in the event that a project is approved which, by itself or in com- <br />bination with other projects approved during that year, exceeds the five percent <br />(5%) of the rental stock yearly limit, those units approved beyond the five percent <br />(5%) figure shall be considered approved wholly for the year during which the pro- <br />ject was approved and shall NOT be deducted from a subsequent year's allowable <br />number of units to be converted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Mohr and Wood <br />NOES: Councilmembers Butler, Kephart, and Mayor Mercer <br />ABSENT: None <br /> <br /> After further discussion, it was moved by Councilmember Butler, and seconded <br />by Mayor Mercer, that Section 2-25.06 Approval Procedures a - be changed to remove <br />a yearly limit on the number of units in approved condominium conversion projects. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, and Mayor Mercer <br />NOES: Councilmembers Mohr and Wood <br />ABSENT: None <br /> <br /> After discussion regarding minor language changes, the City Attorney requested <br />that he be allowed to prepare another draft ordinance incorporating the changes as <br />directed by Council, for further review and consideration at the City Council meet- <br />ing of June 9, 1981.
