301 <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed. <br /> <br /> It was moved by Councilmember Wood, and seconded by Councilmember Butler, that <br />Resolution No. 81-99, after making the following four findings: (1) that because <br />of special circumstances applicable to the property, namely; its location and sur- <br />roundings within a special industrial area devoted to sand and gravel harvesting <br />the strict application of the provisions of the zoning ordinance deprives such <br />property of privileges enjoyed by other properties in the vicinity and under iden- <br />tical zoning classification; (2) that the granting of the variance will not con- <br />stitute a grant of special privilege inconsistent with the limitation on other <br />properties classified in the same zoning district because of the special nature <br />of the site's vicinity; (3) that the granting of the variance will not be detri- <br />mental to the public health, safety, or welfare, or materially injurious to pro- <br />perties or improvements in the vicinity; and (4) that based upon information pro- <br />vided by the Fire Prevention Division the City will be equipped to provide ade- <br />quate fire protection and adjoining properties will not be adversely affected, <br />approval the appeal by Kaiser Sand and Gravel of a decision of the Board of Adjust- <br />ment, and granting a variance for Kaiser Sand and Gravel to allow the construction <br />of an elevator structure as part of an aspbaltic concrete plant that would exceed <br />40 feet-in height on its property at 3311 Stanley Boulevard, zoning for the pro- <br />perty is I-G (General Industrial) District, subject to the following conditions: <br />(1) that no structural element of any asphaltic concrete plant subsequently con- <br />structed shall exceed seventy-six (76) feet in height; (2) that this approval does <br />not in any way establish design, location or site development standards for any <br />asphaltic concrete plant development or other improvements of any type on the sub- <br />Ject property; and (3) that the applicant apply for and be granted design review <br />approval prior to application for a building permit, be adopted. <br />The roll call vote was as follows: <br />AYES: Councft~embers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />Review of the draft revised HousinM Element of the General Plan of the City of <br />Pleasanton formulated pUrSuant to State Government Code S.~ction 65302. and State <br />Housin~ Element Guidelin~s...
