331 <br /> <br /> It was moved by Councilmember Mohr, and seconded by Councilmember Kephart, that <br />Ordinance No. 970, to be read by title only and waiving further reading thereof, <br />approving the application of the City of Pleasanton to prezone an approximately 43 <br />acre parcel located 830 feet south of the existing City Limit Line between Foothill <br />Road and 1-680 to PUD-Low Density Residential with the understanding that no develop- <br />ment plan showing lotting, street locations, etc., is approved at this time and that <br />prior to any construction on the site, a development plan would have to be submitted <br />to the Planning Commission and City Council for separate public hearings, be intro- <br />duced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Butler <br /> <br />~pprove Old Santa Rita Road Sanitar~ Sewer Reimbursement Agreement <br /> Mr. Warnick presented his report (SR 81:87) dated March 17, 1981, regarding <br />this matter, and advising that copies of the proposed agreement had been mailed <br />to all of the affected property owners with a protest form enclosed for return to <br />City Hall. <br /> <br /> The City Attorney advised that no protests had been received regarding this <br />item. <br /> <br /> Mayor Mercer declared the public hearing open. <br /> <br /> Mr. Joseph Madden, 3851 Vineyard Avenue, stated he would answer any questions <br />Council might have. There were no questions. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed. <br /> <br /> It was moved by Councilmember Kephart, and seconded by Councilmember Wood, that <br />Resolution No. 81-78, approving the Old Santa Rita Road Sanitary Sewer Reimbursement <br />Agreement, and authorizing the appropriate City officials to execute the Agreement, <br />be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Butler <br /> <br />MATTERS CONTINUED FOR DECISION <br />Adopt.~.on of Ordinance No. 968~ approvin~ the application of Jack and James Lav~7' <br />to fezone the approximately ~0~000 sq. ft. site containing an existing commercial <br />structure and located at 4183 First Street from the C-S (Commercial Service) Dis- <br />trict to the C-C (Central Commercial) District <br />(Intro. 3-10-8!~ 4-Ayes, 1-No) <br /> Mayor Mercer stated that Ordinance No. 968 was introduced on March 10, 1981, <br />by a vote of 4-Ayes, 1-No, and that it is now in order to adopt the ordinance. <br /> <br /> It was moved by Councilmember Wood, and seconded by Councilmember Mohr, that <br />Ordinance No. 968, approving the application of Jack and James Lavey to fezone <br />the approximately 10,000 sq. ft. site containing an existing commercial structure <br />and located at 4183 First Street from the C-S (Commercial Service) District to the <br />C-C (Central Commercial) District, be adopted. <br /> <br /> a. 3/24/81 <br /> <br /> <br />
