331 It was moved by Councilmember Mohr, and seconded by Councilmember Kephart, that Ordinance No. 970, to be read by title only and waiving further reading thereof, approving the application of the City of Pleasanton to prezone an approximately 43 acre parcel located 830 feet south of the existing City Limit Line between Foothill Road and 1-680 to PUD-Low Density Residential with the understanding that no develop- ment plan showing lotting, street locations, etc., is approved at this time and that prior to any construction on the site, a development plan would have to be submitted to the Planning Commission and City Council for separate public hearings, be intro- duced. The roll call vote was as follows: AYES: Councilmembers Kephart, Mohr, Wood, and Mayor Mercer NOES: None ABSENT: Councilmember Butler ~pprove Old Santa Rita Road Sanitar~ Sewer Reimbursement Agreement Mr. Warnick presented his report (SR 81:87) dated March 17, 1981, regarding this matter, and advising that copies of the proposed agreement had been mailed to all of the affected property owners with a protest form enclosed for return to City Hall. The City Attorney advised that no protests had been received regarding this item. Mayor Mercer declared the public hearing open. Mr. Joseph Madden, 3851 Vineyard Avenue, stated he would answer any questions Council might have. There were no questions. There being no further testimony, Mayor Mercer declared the public hearing closed. It was moved by Councilmember Kephart, and seconded by Councilmember Wood, that Resolution No. 81-78, approving the Old Santa Rita Road Sanitary Sewer Reimbursement Agreement, and authorizing the appropriate City officials to execute the Agreement, be adopted.
