333 <br /> <br />The roll callvote was as follows: <br />AYES: Councilmembers Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Butler <br /> <br />SPECIAL REPORTS <br /> There were no Special Reports presented at this meeting. <br /> <br />REPORTS OF BOARDS AND COMMISSIONS <br />Actions Taken by the Planning Commission at their meetins of 3-11-81 <br /> Mr. Harris presented his report (SR 81:80) dated March 12, 1981, regarding <br />this matter for the information of the Council. No action was required or taken <br />by Council on this item. <br /> <br />Actions Taken by the Board of Adjustment and DesiSn Review Board at their meeting <br />of 3-12-81 <br /> Mr. Harris presented his report (SR 81:81) dated March 13, 1981, regarding <br />this matter for the information of the Council. Council questioned the contin- <br />uance by the Board of Adjustment of the application of Ted Mavridis for a variance <br />to allow the construction of a 2,000 sq. ft. apartment complex, and requested that <br />this itembe considered as soon as possible. <br /> <br />Actions Taken by the Planning Commission at their meetins of 3-18-81 <br /> Mr. Harris presented his report (SR 81:93) dated March 19, 1981, regarding <br />this matter for the information of the Council. No action was required or taken <br />by Council on this item. <br /> <br />REPORTS OF THE CITY MANAGER <br />Request for Septic Tank Permit Foothill Road - Mark Andersen <br /> Mr. Warnick presented his report (SR 81:'86) dated March 17, 1981, regarding <br />this matter. Mr. Warnick advised that this application is in conflict with City <br />Council policy relating to approval of septic tanks, therefore, staff recommends <br />the application be denied unless some change is made in the policy on septic tank <br />usage. <br /> <br /> Mr. Harris explained that a decision on the application for lot split has been <br />continued until a decision is made by Council whether or not to allow a septic tank <br />that is not in conformance with City Council policy. <br /> <br /> Mr. Steve Andersen, Attorney representing his father, Mark Andersen, stated he <br />felt that item 16 of the septic tank policy which states that Council has the right <br />to review certain applications that do not fall under the regular guidelines, would <br />allow Council to determine unique circumstances in this instance and to approve the <br />application. Mr. Andersen reviewed the background of the property stating that his <br />father purchased the land twelve years ago with the intent to subdivide at some <br />future time. He requested Council to approve the septic tank application because <br />there are no geotechnical considerations involved that would affect health, safety, <br />and welfare, and it would not set a precedent as there are no other properties with <br />similar circumstances. <br /> <br /> Council discussion ensued regarding leech lines and soils studies relative to <br />drainage onto other properties in the area. <br /> <br /> Mr. Judd Hull, of Judd Hull and Associates Geotechnical Consultants, reviewed <br />the site reconnaissance that he conducted in connection with the proposed lot split, <br />which is detailed in reports from Mr. Hull to Mr. Andersen dated January 12 and <br />March 6, 1981. <br /> <br /> 9. 3/24/81 <br /> <br /> <br />
