335 <br /> <br /> Mr. Andersen stated that no one can determine at this time where the drainage <br />is coming from or the cause of the problem. <br /> <br /> Ms. Sue Krupke, adjacent neighbor of Mr. Andersen, stated she was not opposed <br />to the lot split and installation of septic tank, and urged Council to approve the <br />application. <br /> <br /> The following persons spoke in opposition to this application: <br /> <br /> Mr. Robert J. Reynolds, 1588 Foothill Road, stated he was not opposed to the <br />lot split but felt there should first be additional soils analysis done in order <br />to eliminate any drainage problems. <br /> <br /> Mr. John Innes, 1586 Foothill Road, stated there were already six septic'tanks <br />in the ~mmediate area no more than 250 feet apart. He stated he had concerns about <br />increased traffic and seepage problems. <br /> <br /> Mr. Steve DeCoite, 1500 Foothill Road, urged denial of the application. He <br />stated this is a part of the City that should not be split into lots less than <br />60,000 sq. ft., in order to retain the rural atmosphere. He stated he disagreed <br />with any more piecemeal cutting up of the area or installation of extra septic <br />tanks. He added he felt to approve this application would be a disservice to <br />surrounding property owners and the future of the City. <br /> <br /> Mr. Bob Scott stated he felt the present ditch to accommodate the drainage <br />problem is only temporary and that this situation should be permanently corrected. <br /> <br /> Mr. Gil Barbee, 147 Bernal Avenue, spoke in favor of the application. He <br />stated the drainage problem is a surface drainage problem and not Mr. Andersen's <br />fault or responsibility. He added the new lot would not have any effect on the <br />surrounding properties. <br /> <br /> Mr. Andersen rebutted by stating that other septic tanks had been approved on <br />lots less than five acres, and there is no geotechnical reason to deny his father's <br />application. <br /> <br /> Councilmember Kephart asked Mr. Andersen if he would be willing to maintain <br />the current drainage ditch and be responsible for weed abatement. Mr.-Andersen <br />stated he would be willing to negotiate an agreement to maintain the ditch. <br /> <br /> Councilmember Kephart stated the applicant had purchased the land twelve years <br />ago to do what he is doing now and other people feel they will be adversely affected <br />by it. He stated the only issue before Council tonight is consideration of the <br />septic tank application. He added that any odor problems should be made through <br />appropriate protest notice. <br /> <br /> Councilmember Wood stated he would like to see the neighbors cooperate to solve <br />problems in the area. <br /> <br /> Councilmember Mohr stated it could not be precluded that approval of this <br />application would not set a precedent. <br /> <br /> Mayor Mercer stated he is not sure where the drainage problem on surrounding <br />properties is originating from and until that information is received he will not <br />vote for approval of another septic tank. <br /> <br /> 10. 3/24/81 <br /> <br /> <br />
