Comments on this decision may be directed to either the Planning staff <br />prior to the above mee.ting date~ or directly to the City Council at the above <br />noticed meetin~ <br /> Mr. Harris presented his report (SR 81:42) dated February 3, 1981, regarding this <br />matter. <br /> <br /> Mayor Mercer declared the public hearing open on the application and the Negative- <br />Declaration. <br /> <br /> Mr. Jack Bras, Architect representing Tracor-MBA, stated his client concurred <br />with the staff report. Mr. Bras asked if Planning Commission Condition No. 3 would <br />allow the applicant to subdivide and develop in phases. Mr. Harris stated the <br />City Attorney's opinion is that the Code requires a precise plan on the entire <br />property before it can be completely subdivided, but a parcel can be subdivided <br />if it is larger than two acres and developed in phases where there is a precise <br />plan on lots to be divided. Mr. Bras stated his client concurred with the condi- <br />tions established by the Planning Commission on this application. <br /> <br /> Mr. James Miller, 3633 Camelot Court, voiced objection to this application be- <br />cause of the adverse impact of traffic in the area. He cited the large number of <br />trucks parking around McDonald's Restaurant and their difficulty in maneuvering <br />the ingress and egress at this location. He stated he understood there was to be <br />a traffic signal installed when this parcel is developed but he felt there is a <br />need for one now and that it should be required. <br /> <br /> Mr. Terry GroSshans, 3926 Fairlands Drive, stated he concurred with the previous <br />speaker; that truck traffic at McDonald's is excessive. He stated he felt develop- <br />ment of this area should be accomplished all at one time, not piecemeal, and that it <br />would be a disaster to start the development on Santa Rita Road. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing closed <br />on the application and the Negative Declaration. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Wood, that <br />Resolution No. 81-30, determining on the basis of a review of initial environmental <br />study done for this project, that no significant environmental impact would occur as <br />outlined in the City's guidelines and that a Negative Declaration is appropriate to <br />fezone a 9.35 acre site located on the south side of Pimlico Drive between Santa Rita <br />Road and Brockton Drive from CF (Commercial Freeway) to Planned Unit Development- <br />Commercial, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> Councilmember Butler stated he felt traffic conditions in this area have changed <br />in recent months and should be carefully watched. Mayor Mercer instructed staff to <br />investigate truck traffic problems at McDonald's Restaurant. <br /> <br /> After discussion, it was moved by Councilmember Wood, and seconded by Council- <br />member Butler, that Ordinance No. 961, to be read by title only and waiving further <br />reading thereof, approving the application of Tracor-MBA to rezone a 9.35 acre site <br /> <br /> 7. 2/10/8z <br /> <br /> <br />
