month review there was no neighborhood opposition expressed. Councilmember Kephart <br />stated he felt that a 6 month review should be a condition included on these two <br />permits. <br /> <br /> Councilmember Mohr stated she had visited daycare centers and felt they were <br />managed well. She stated that other daycare centers had been approved by the Plan- <br />ning Commission without any complaints ever being received on them, and that there <br />was very little reason to expect any complaints from these two centers. <br /> <br /> It was moved by Councilmember Mohr, and seconded by Councilmember Kephart, to <br />approve the appeals of Faris Reali and Christine Hoptry, and to grant the Conditional <br />Use Permit to allow a maximum of twelve children in their respective day care centers, <br />with a review to be scheduled in six months to ascertain if there had been any com- <br />plaints filed against the centers. ~ <br /> <br /> Mayor Mercer stated he felt there was no reason to have a six month review of <br />these daycare centers, and that they were important and logical centers in the <br />neighborhood. <br /> <br /> It was moved by Mayor Mercer, and seconded by ~ouncilmember Butler, to amend the <br />motion to eliminate the six month review as a condition for approval of the Conditional <br />Use Permit. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, Wood, and Mayor Mercer <br />NOES: Councilmember Kephart <br />ABSENT.: None <br /> <br /> Due to the above motions, the formal Council action is as follows: <br /> <br /> It was moved by Councilmember Mohr, and seconded by Councilmember Kephart, that <br />Resolution No. 81-6, approving the appeal of Faris A. Reali, and granting a Conditional <br />Use Permit to allow day care for up to a maximum of twelve children at her residence at <br />3968 Empire Court, subject to conditions sho~n in the staff report dated December 10, <br />1980, but without a six month review, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> It was moved by Councilmember Mohr, and seconded by Councilmember Kephart, that <br />Resolution No. 81-7, approving the appeal of Christine Hoptry, and granting a Condi- <br />tionaly Use Permit to allow day care for up to a maximum of twelve children at her <br />residence at 4123 Payne Road, subject to conditions shown in the staff report dated <br />December 10, 1980, but without a six month review, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> Councilmember Butler left the meeting at 8:55 P.M., due to illness. <br /> <br />Application of the Cit7 Council to amend Section 2-5.38~ ArtiClp 3~ Chapter 2~ Tit.le <br />II of the Ordinance Code of the City of Pleasanton to change the rear yard setback <br />and open space requirements for the R-1-6500~ R-iT750.0~ R-!-8500 and RM~4000 resi- <br />dential districts <br /> Mr. Harris presented his report (SR 81:09) dated January 7, 1981, regarding this <br />matter. <br /> <br /> 5. 1/13/81 <br /> <br /> <br />
