- ' 177 <br /> <br /> Resolution Ordering the Annexation of Annexation No. 84 (Yee) <br /> Mr. Warnick presented his report (SR 81:443) dated December 15, 1981, regarding <br /> this matter. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Mohr, that <br />Resolution No. 81-441, ordering the annexation of Annexation No. 84, Yee property, <br />approximately 51 acres of land located on the west side of Foothill Road directly <br />opposite Foothill High School, be adopted. <br />The roll call vote was as fo~llows: <br />AYES: Councilmembers Butler, Mohr, andMayor Mercer <br />NOES: Councilmember Wood <br />ABSENT: Councilmember Kephart <br /> <br />Report on Proposed Annexation ofthe KottinMer Ranch (231 Acres South and East of <br />the Intersection of Pico Avenue and Kottinger Avenue) <br /> Mr. Warnick presented his report (SR 81:442) dated December 15, 1981, regarding <br /> this matter. <br /> <br /> Mr. Ted Fairfield, Civil Engineer representing Hansen Associates, presented a <br />map showing the location of the property. He stated the property constitutes an <br />island annexation, and if LAFCO will not accept this, then a corridor could be <br />created if necessary. <br /> <br /> After discussion, it was moved by Councilmember Butler, and seconded by Mayor <br />Mercer, approving the request for annexation of Hartsen Associates of 231 acres south <br />and east of the intersection of Pico Avenue and Kottinger Avenue (Kottinger Ranch), <br />instructing staff to prepare a formal resolution requesting this annexation and an <br />application to LAFCO, and requiring the applicant to either have an acceptable legal <br />description and map of the proposed annexation (meeting LAFCO standards) prepared by <br />a licensed civil engineer or land surveyor or pay a fee determined by the City Engi- <br />neer to cover the costs of preparation of the description and map by the City. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, and Mayor Mercer <br />NOES: Councilmember Wood <br />ABSENT: Councilmember Kephart <br /> <br />Report on proposed boundary chan~es for the North Pleasanton Assessment District <br /> Mr. Warnick presented his report (SR 81:445) dated December 16, 1981, regarding <br />this matter. <br /> <br /> Mr. Walker advised that several special meetings had been held to discuss the <br />boundaries for the North Pleasanton Assessment District and the following changes <br />are being requested: that all parcels less than 2 acres be removed from the Assess- <br />ment District; remove residential properties from the Assessment District but in- <br />clude improvement costs for those properties fronttng Hopyard Road; remove TyCal's <br />project from the Assessment District; Farmers Insurance and Citizens Savings pro- <br />perties will be in a separate assessment district, remove Parcel 61 from the Assess- <br />ment District; Morrison and Parcel 1 could be removed if they enter into a separate <br />agreement. Mr. Walker stated that guidance is n~eded from the City Council as to <br />what should be included in the preliminary Assessment District boundaries so that a <br />formal petition can be circulated to enter into the Assessment District, with pro- <br />test hearings to be scheduled later. <br /> <br /> The City Attorney advised that it is difficult to exempt non-profit organizations <br />such as hospitals from an assessment district in general law cities. <br /> <br /> ii. i2/22/8i <br /> <br /> <br />
