299 <br /> <br />Report on Request for Annex~tion of the 2.6 acre O~ler Prop~tX. at the north end <br />of Virginia I~y <br /> Mr. Warnick presented his report (SR 81:425) dated December 1, 1981, regarding <br />this matter. <br /> <br /> After discussion, it was moved by Councilmember Wood, and seconded by Council- <br />member Mohr, to deny the request for annexation of the 2.6 acre Oyler property at <br />the north end of Virginia Way because this proposed annexation would be surrounded <br />by the Arroyo Del Valle on the north and unincorporated parcels on the other three <br />sides, its only access is by unimproved private roads in the unincorporated island, <br />and the water system in the area is extremely poor. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />Matters for the Information of the Council <br /> Mayor Mercer presented the information report of the Director of Public Works <br />and Utilities (IR 81:36) dated November 30, 1981, transmitting the Minutes from the <br />Staff Traffic Committee meeting of November 18, 1981. <br /> <br /> Mayor Mercer presented the information report of the Director of Public Works <br />and Utilities (IR 81:37) dated December 2, 1981, regarding the completion of Gold <br />Creek Renovation Work, stating that this work is complete and the City'Attorney will <br />file a Notice of Completion. <br /> <br /> Mayor Mercer presented the information report of the City Manager (IR 81:38) <br />dated December 3, 1981, regarding the medfly spraying. program and answering ques- <br />tions raised by the City Council at their meeting of November 24, 1981. <br /> <br /> Mayor Mercer presented the City Council Agenda Planning Report for the months <br />of December, January, and February. <br /> <br />REPORTS OF THE CITY ATTORNEY <br />Happy Valley Area - AnneXation and Zoning <br /> Mr. Levine presented his report (SR 81:426) dated December 1, 1981, regarding <br />this matter. <br /> <br /> Mayor Mercer suggested this report be discussed with the Alisal Improvement Club <br />before any further action is taken, to receive input from the Happy Valley residents <br />regarding this issue. Council concurred. <br /> <br /> Mayor Mercer recessed the meeting at 9:50 P.M. <br /> <br /> Mayor Mercer reconvened the meeting at 9:55 P.M. <br /> <br />Mitigating Measures Agreements with Reynolds and Browns. and Kaiser/Permanente <br /> Mr. Levine presented his report (SR 81:439) dated December 8, 1981, regarding <br />this matter. He reviewed the draft agreements in detail. <br /> <br /> Mr. Walker explained that staff is concerned about potential unknown costs and <br />wants to make every effort possible to insure that the City will not be burdened <br />with any financial liability later on related to these projects. <br /> <br /> Mr. David Brown, representing Reynolds and Brown, advised that public improve- <br />ments are under construction now and they expect to be taking out individual build- <br />ing permits shortly with construction to begin in early spring. He stated they had <br />agreed to some 70 conditions on the Planned Unit Development, and want some assur- <br /> <br /> 10. 12/8/81 <br /> <br /> <br />
