201' <br /> <br />Application of Southern Pacific Transportation Company for development <br />plan approval Of an approxi~ately.70~000 sq. {t. commercial/offic[ <br />development to be located between First Street and the SPRR right-of- <br />way from Angel~ Street to .the exte~si0n of Bernal Avenue and between <br />Neal Street, Angela Street, the SPtkR ri ht-of-way and a line approxi- <br />mately 250 feet east of'Main Str~eet, anR rez0ning to <br /> of the site <br />PUD-Commercia~/Offices, also to rezone the Delucchi and.Wayside Parks <br />located on the west side of First Street between Angeia Street and a <br />point approximately ~50 feet north of'Nell Street from C-C (Central <br />Commercial) to PUD (Planned Unit Development2Open Space, Pa~ks ~nd <br />Recreation) 8r to a~y o~her zoning' district Consi'st~nt with the General <br />Plan. The property is ZOned C-C (Central Commercial) and O(Office) <br />Districts. <br /> Mr. Steve Gibson, P, O. Box 910, Colfax, California, presented <br />the changes in their plan which provides additional parking spaces as <br />required by the Council. He then requested that condition number 50, <br />which requires execution of a lease for the Delucchi and Wayside Parks <br />.between City and Southern Pacific prior to final approval of the case, <br />be removed. <br /> <br /> Mr. Bill Gale, 62 W. Neal Street, spoke to clarify the allocation <br />of parking spaces and the grant to him from Southern Pacific of <br />perpetual easements for parking. He also brought up the fact that there <br />may be a Heritage tree in the area to be cleared for parking, and wanted <br />to be sure that would not stop development of the area. <br /> <br /> There being no further testimony, Mayor Mercer declared the public <br />hearing closed on the application and the negative 'declaration. <br /> <br /> It was moved by Councilmember Wood, and seconded by Councilmember <br />Mohr, that Resolution No. 81-406, determining on the basis of a review <br />of initial environmental study done for this project, that no significant <br />environmental impact would occur as outlined in the City's guidelines <br />and that a mitigated negative declaration is appropriate for the project, <br />be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> The city attorney presented his report regarding approval of the ten <br />year lease between the City and Southern Pacific for theDelucchi and <br />Wayside Parks. Council indicated concern over the lack. of a renewal <br />provision and the cost of returning the property to its original condition <br />at the end of the lease period. <br /> <br /> The project was then discussed by the Council in detail. Council- <br />member Mohr expressed concern with the number of rose Bushes to be <br />removed and suggested a condition be added to the development plan <br />approval requiring any roses that cannot be'reused on the site to be <br />relocated to the Century House. <br /> <br /> -5- 11/24/81 <br /> <br /> <br />
