21.1. <br /> <br /> Hayor Hercer also requested a report regarding what the city must <br />do to annex the Happy Valley area. ~o~at is the financial impact and can <br />it retain the rural atmosphere? <br /> <br />CITY COUNCIL COmmITTEE REPORTS <br /> Councilmember Butler reported that at the last LAVWMA meeting <br />they voted in accordance with the position taken by the city that the <br />EIR will be certified and the agency will be disbanded when all necessary <br />actions have occurred. <br /> <br /> Mayor Mercer announced that at the Mayors' Conference two people <br />from Pleasanton were appointed to the Conmaission on Aging, Karin Hohr <br />and Gerald Case with their terms to expire in 1984. <br /> <br />~-~ETING OPEN TO THE PUBLIC <br /> <br /> Helen McHutt, 4397 Second Street, a local realtor, spoke on behalf <br />of Robbie Steffan and Ida Rogers regarding the application for an ice <br />cream parlor downtown. She indicated that parking was going to be a <br />problem anywhere downtown and indicated she would like Council to <br />reconsider its denial of the application. Mayor Mercer indicated Council <br />could not change its decision at this time, but that Ms. Steffan and <br />Ms. Rogers could reapply to the Planning Commission and begin the process <br />again. <br /> <br /> Mr. Frank Lowenthal, 4586 Gatetree Circle, addressed the Council <br />regarding the malathion spraying of P.leasanton. He indicated he would <br />like the city attorney to prepare a feasibility study regarding a suit <br />against the state to cease spraying based arbitrariness of the spraying <br />program and lack of administrative direction and control of that program. <br />Hewanted the city attorney to contact the officials of the Medfly program <br />to find outwhy. the spraying stopped at Santa Rita Road with spraying <br />on the west side and not on t he east side. He raised the point about <br />the dangers from helicopters crashing.' <br /> <br /> Discussion then ensued regardingthe spraying and problems with <br />initiating such a lawsuit. The conclusion reached was that better <br />communications were necessary and the staff should contact the Medfly <br />people to try and get more information. <br /> <br /> Mr. Ted Williams, 5196 Golden Road, indicated he is a tenant of <br />the building where the ice cream parlor will be located if approved. <br />He feels he will be evicted, which will cause him to become bankrupt <br />if the development is approved. <br /> <br /> Joyce Getty, 925 Kottinger Drive, indicated she had been advised <br />by the city attorney that she could not speak regarding issues affecting <br />the downtown are~ because of her position On the Planning Commission. <br />She strongly objected to this and indicated she would like an opinion <br />from the Attorney General on this issue. The city attorney indicated the <br />Attorney General would most likely defer to the Fair Political Practices <br />Commission and the best thing to do was to research their opinions or <br />to request a current ruling on the situation. <br /> <br /> Ms. Getty indicated the Planning Commission should all get a copy <br />of the memo that was sent to her. She further stressed that whenever <br />a study session is scheduled to consider the Peters Avenue area or <br /> <br /> -3- 11/24/81 <br /> <br /> <br />
