Comments on this decision may be directed to either the <br /> Planning staff prior to the above meeting date~ or directly to the City Council <br /> at the above noticed meetin~ <br /> Mr. Harris presented his report (SR 81:298) dated September 1, 1981, regarding <br /> this matter. <br /> <br /> Mayor Mercer declared the public hearing open on the application and the <br /> negative declaration. <br /> <br /> Mr. Ted Fairfield, Civil Engineer, representing the applicant, presented back- <br /> ground information of the property and stated that a complete development plan had <br /> been submitted to Council. He reviewed the various concerns and the specific solu- <br /> tions related to density, increased yard areas, sound wall, scenic highway element, <br /> and parking. He stated he felt the duplexes should qualify as single-family homes, <br /> and he emphasized that the separate townhouse units were notcondnminiums. Mr. Fair- <br /> field stated this project could not be started earlier than six months from now and <br /> will not be completed for several years, and will not precede the Las Positas over- <br /> crossing. He stated that the Planning Commission took action deleting Condition No. <br /> 27 relative to street widths on Elmwood Circle and Joshua Circle, and he requested <br /> Council to do likewise. <br /> <br /> Mr. Otis Bradshaw, 7208 Tulipwood Circle, stated he Vehemently opposed this <br /> application because of adverse noise impact and increased traffic in the area. He <br /> stated there was no provision for RV's. He concluded by stating he felt the land <br /> could be put to better use. <br /> <br /> Mr. Frank Damerval, 5381 Springdale, took exception to some of the remarks of <br /> the previous speaker regarding sound impact and traffic figures quoted. <br /> <br /> Mr. Ted Fairfield rebutted by stating there is adequate parking provided'for <br /> this project, but that these units are not designed for RV parking. He added he <br /> felt there will be adequate sound protection. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br /> closed on the application and the negative declaration. <br /> <br /> It was moved by Councilmember Kephart, and seconded by Councilmember Mohr, that <br /> Resolution No. 81-301, determining on the basis of a review of initial environmental <br /> study done for this project, that no significant environmental impact would occur as <br /> outlined in the City's guidelines and that a mitigated negative declaration is appro- <br />-- priate for Planned Unit Development zoning and development plan approval for a 121- <br /> unit townhouse/duplex residential complex proposed to be located on the east side of <br /> Muir~ood Drive, between West Lag Positas Boulevard, Lemonwood Way and Interstate 680, <br /> be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Kephart, Mohr, Wood, and Mayor Mercer <br /> NOES: None <br /> ABSENT: Councilmember Butler <br /> <br /> 5. 9/8/81 <br /> <br /> <br />
