461 <br /> <br /> Mayor Mercer declared the public hearing open. <br /> <br /> No one in the audience spoke in favor of this application. <br /> <br /> Mr. Lee Henderson, 2870 Foothill Road, asked quasttons regarding the number of <br />RAP allocations that could be issued in one year, when are they paid for, and who <br />is exempt. Mayor Mercer explained that Council can approve any number of exemptions <br />but that only 40 can be allowed in one year with no more than 10 for each developer <br />or project, and the permits are paid for when issued. He added that the Residential <br />Allocation Program ordinance lists the exemptions that are to be allowed. <br /> <br /> Mr. Kirk Doughtry stated he was opposed to this development because it will <br />adversely impact his view. ~yor Mercer stated the only matter being considered <br />on this item tonight is whether or not it qualifies for RAP exemption. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing closed. <br /> <br /> Councilmember Butler stated he had not be in favor of large lot exemptions from <br />the Residential Allocation Program at the time the ordinance was adopted and had voted <br />against it, but he felt this application fit the requirements for exemption from the <br />RAP ordinance and.therefore should be approved. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Mohr, that <br />Resolution No. 81-243, after determining that this request meets the requirements <br />for exemption under the Residential Allocation Program ordinance, approve the request <br />of Roger Manning for an exemption from the Residential Allocation Program (RAP) for <br />a 16-lot subdivision proposed for the approximately 10 acre site located at the north- <br />east corner of Foothill Road and Muirwood Drive, the property is zoned R-i-20,000, be <br />adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Kephart <br /> <br />Request of Castlewood Properties for an exemption from the Residential Allocation <br />.Program (RAP) for a 23-1ot Hillside Planned Development P~oje.ct. proposed for the <br />approximately 48 acre site located on the west side of Foothill Road near its <br />intersection with Bernal Avenue <br /> Mr. Harris presented his report (SR 81:250) dated July 20, 1981, regarding this <br />matter. <br /> <br /> Mayor Mercer declared the public hearing open. <br /> <br /> Mr. Art Dunkley, representing Castlewood Properties, stated he concurred with <br />the staff report, and he requested approval of this exemption from the Residential <br />Allocation Program ordinance. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing closed. <br /> <br /> It was moved by Councilmember Mohr, and seconded by Councilmember Wood, that <br />Resolution No. 81-244, after determining that this request meets the requirements <br />for ~xemption under the Residential Allocation Program ordinance, approve the re- <br />quest of Castlewood Properties for an exemption from the Residential Allocation <br />Program (RAP) for a 23-1ot Hillside Planned Development Project proposed for the <br />approximately 48 acre site located on the west side of Foothill Road near its inter- <br />section with Bernal Avenue, be adopted. <br /> <br /> 6. 7/28/81 <br /> <br /> <br />
