483 <br /> <br /> Councilmember Wood abstained from participation on thts item due to Conflict <br />of Interest. <br /> <br /> Mr. Larry Messa, adjacent property owner, stated he was opposed to this item. <br />He stated he had concerns about inadequate access, traffic hazards, lack of fire <br />protection, and availability of sewer.' Mayor Mercer stated that these concerns <br />will be addressed at the time of consideration of development plan if the property <br />is annexed. <br /> <br /> Mr. Judd Hull, geotechnical consultant, stated he was neither for or against <br />the annexation but had concern about some previous grading that could cause pro- <br />blems for development of this property. <br /> <br /> Mr. William Hirst, Attorney representing Castleridge Enterprises, stated he was <br />not aware of any previous grading on this property. <br /> <br /> Council discussion ensued regarding the advantage of having this property <br />annexed to the City in order to-have better control of its development. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Kephart, <br />instructing staff to prepare a formal resolution regarding the annexation and an <br />application to LAFCO for the 230 acres west of Foothill Road and south of Santog <br />Ranch Road owned by Castleridge Enterprises, and requiring Castleridge Enterprises <br />to either have an acceptable legal description and map of the proposed annexation <br />meeting LAFCO standards prepared by a licensed civil engineer or pay a fee deter- <br />mined by the City Engineer to cover the costs of preparation of the description. <br />and map by the City. <br />The roll call vote was as follows: <br />AYES: Councilm~be~S Buti'a~,'Kephart, Mohr, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: Councilmember Wood <br /> <br />Report on Proposed Annexation - Bates (20 acres north oil Mineyard Avenue) <br />Mr. Warntck presented his report (SR 81:240) dated July 8, 1981, regarding <br />matter. <br /> <br /> Mr. T. A. Bates, 3153 Vineyard Avenue, stated he would like to have the property- <br />annexed to the City and the zoning changed from mobile home parks to medium density <br />residential, mobile homes, and affordable homes. <br /> <br /> It was moved by Councilmember Kephart, and seconded by Councilmember Mobr, that <br />staff be instructed to prepare a formal resolution regarding the annexation and an <br />application to LAFCO for the 20 acres north of Vineyard Avenue owned by T. A. Bates, <br />and requiring Mr. Bates to either have an acceptable legal description and map of <br />the proposed annexation meeting LAFCO standards prepared by a licensed civil engi-- <br />neer or pay a fee determined by the City Engineer to cover the costs of preparation <br />of the description and map by the City. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer' <br />NOES: None <br />ABSENT: None <br /> <br /> It was moved by Councilmember Kephart, and seconded by Councilmember Butler, to <br />initiate an ordinance change to prezone the 20 acres north of Vineyard Avenue owned <br />by T.
