Adoption of Ordinance No. 1021~ approving the application of Thomas J. Orloff for development plan approval and PUD-High Density Residential zoning which would allow the construction of 150 apartment units and 20 condominium units on a 9.31 acre site located on the south side of Valley Avenue immediately west of Safeway Sho~ ping Center~ north of Amador Park~ and east of the single-family residential lots frontin~ on Brooktree Way ..(Intro. 2-9-82~ 4-Ayes~ 1-No) Mayor Mercer stated that Ordinance No. 1021 was introduced on February 9, 1982, by a vote of 4-Ayes, 1-No, and that it was now in order to adopt the ordinance. It was moved by Councilmember Butler, and seconded by Councilmember Kephart, that Ordinance No. 1021, approving the application of Thomas J. Orloff for development plan approval and PUD-High Density Residential zoning which would allow the construc- tion of 150 apartment units and 20 condominium units on a 9.31 acre site located on the south side of Valley Avenue immediately west of Safeway Shopping Center, north of Amador Park, and east of the single-family residential lots fronting on Brooktree Way, be adopted. The roll call vote was as follows: AYES: Councilmembers Butler, Kephart, Mohr, and Mayor Mercer NOES: Councilmember Wood ABSENT: None Adoption of Ordinance No. 1023~ modifying the City's Growth Management Regulations by amending Title II~ Chapter 13 (Residential Allocation Program) in its entirety (Intro. 2-9-82t 5-Ayes) Adoption of Implementing Resolution relative to the City's Growth Management Ordinance (Contd. from 2-9-82) Mr. Swift presented his reports (SR 82:79 and SR 82:80) dated February 18, 1982, regarding these matters. Council reviewed the reports and made the following changes: It was moved by Councilmember Butler, and seconded by Councilmember Wood, to amend the ordinance as follows: Section 2-20.01, second paragraph be corrected changing the word "dispersing" to "dispensing"; clarify Section 2-20.04(a) to mean construction of one single-family residence on a lot in existence; add an exemption for minor subdivisions (four lots or less); and in Section 2-20.05(b)(2) Lower- Income Housing Set-Aside, change the word "shall" to "may".
