He presented background information relative to PG&E's expenditures, <br /> earnings, number of employees, gas received from Canada via pipeline, and conserva- <br /> tion. He stated there are presently three pieces of legislation pending to reconsider <br /> the most recent rate hike as well as to change the method of selecting PUC Commis- <br /> sioners. After discussion, Council referred this matter to staff for further review <br /> of the proposed legislation. <br /> <br /> PUBLIC HEARINGS <br />Appeal of Valley Business Associates of a decision of the Planning Commission fienying <br />a major modification to Case PUD-80-1 to change the streets in the business ~rk pro~ <br />posed for the 69 acre site located south of Valley Avenue and east of the residences <br />on Kolln Street from private to public <br /> (Contd. from 11-10-81 and 12-8-81) <br /> <br />Resolution Accepting Proposal for Special Assessment Proceedings - Valley Business <br />Park Assessment District <br /> Mr. Harris presented his report (SR 81:427) dated December 1, 1981, regarding the <br />appeal of Valley Business Associates. Mr. Warnick presented his report (SR 81:384) <br />dated February 17, 1982, regarding the Special Assessment Proceedings for the Valley <br />Business Park Assessment District. <br /> <br /> Mayor Mercer declared the public hearing open on the appeal. <br /> <br /> Mr. Greg Davies, representing Valley Business Associates, asked for an overriding <br />decision of the Planning Commission decision on this matter. He stated his firm <br />would like to form an assessment district to maintain street, street lighting, land- <br />scaping, and other improvements. <br /> <br /> Mr. Harris presented an amendment to Condition 10 as follows: " .... The 30 ft. <br />wide western landscape buffer, the 30 ft. wide Valley Avenue landscape strip, the <br />landscape median in Quarry Lane, and the landscape median in Valley Avenue from the <br />eastern boundary of the Valley Business Park to Santa Rita Road shall be maintained <br />by the property owners association or a landscape maintenance district as a part of <br />the landscape maintenance district. The district shall be established prior to issu- <br />ance of any building permits on the subject property." <br /> <br /> Mr. Harris also requested that an additional condition be added as Condition 50 <br />as follows: "That all street lighting within the project shall be maintained by the <br />property owners' association or by a lighting maintenance district; said district <br />shall be formed prior to the issuance of any building permits on the subject property~v <br /> <br /> Mr. Davies agreed to all of the conditions as submitted in the staff report and <br />as presented above. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing closed <br />on the appeal. <br /> <br /> Councilmember Mohr expressed concern regarding the limitations of Proposition 4 <br />and the City still being able to provide adequate services. Mrs. Wagner advised that <br />the preliminary CRIS model fiscal impact results for North Pleasanton development <br />show adequate means to provide services in this area, with the City either not reach- <br />ing its future Proposition 4 limits or reaching them only after allowing substantial <br />new revenues for providing services to that area. <br /> <br /> 4. 2/23/82 <br /> <br /> <br />
