351 <br /> <br /> It was moved by Councilmember Mohr, and seconded by Councilmember Wood, <br /> that Ordinance No. 1056, to be read by title only and waiving further reading <br /> thereof, approving the application of Ken Earp, et al, for PUD development <br /> approval for an approximately 238 unit manufactured housing project for <br /> an approximately 29 acre site located on the north side of Vineyard Avenue <br /> opposite Sauterne Way, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Brandes, Mohr and Wood <br /> NOES: Councilmember Mercer and Mayor Butler <br /> ABSENT: None <br /> <br /> Agreement with Quail Creek Implementing Resolution No. 81-287 <br /> Council and staff had discussions re the increase of the house prices <br /> and ways of controlling this. Councilmember Mercer was most concerned that <br />~ the affordable housing competition was for plans of 200 units at a set price <br /> and this development does not meet those requirements. The developer agreed <br />~' that costs of any ensuing litigation would not be added to the cost of the <br />~D units, but increases in actual construction costs would be added. <br />[] It was moved by Councilmember Brandes, and seconded by Councilmember Wood, <br />[] that Resolution 82-470, approving the agreement with Quail Creek with the <br /> two changes proposed by the City Attorney in his staff report (SR 82:470) <br />~[ and clarification of a "whereas" clause in the agreement to remove the <br /> implication that sewer capacity is guaranteed, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Brandes, Mohr and Wood <br /> NOES: Councilmember Mercer and Mayor Butler <br /> ABSENT: None <br /> <br /> Adoption of Ordinance No. 1057, amending the Growth Management Program <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Brandes, <br /> that Ordinance No. 1057, amending the Growth Management Program, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Brandes Mohr and Mayor Butler <br /> NOES: Councilmembers Mercer and Wood <br /> ABSENT: None <br /> <br /> Adoption of Ordinance No. 1059, approving the application of Shell Oil Company <br /> to rezone approximately 1.2 acres located at the southeast corner of Hopyard <br /> Road and Johnson Drive from "C-F" (Commercial Freeway) District to the PUD <br /> (Planned Unit Development)-Commercial District and for development approval <br /> for a 2,830 sq.ft. service station facility including a convenience market <br /> and automatic car wash <br /> It was moved by Councilmember Mercer, and seconded by Councilmember <br /> Brandes, that the above Ordinance No. 1059 be adopted. Councilmember Mohr <br /> moved to include a condition that if the station is abandoned for ninety days <br /> that it be removed, but the motion died for lack of a second. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Brandes, Mercer, Mohr, Wood and Mayor Butler <br /> NOES: None <br /> ABSENT: None <br /> <br /> SPECIAL REPORTS <br /> <br /> There were none. <br /> <br /> 9. 11/23/82 <br /> <br /> <br />
