289 <br /> <br /> Mayor Butler declared the public hearing open on the application and the nega- <br /> tive declaration. <br /> <br /> Mr. Barry Fernaid, representing Devcon, stated he had no problems with conditions <br /> attached to the staff report. He stated he had talked to the concerned residents in <br /> the area in an attempt to satisfy their concerns, and had increased the landscaping. <br /> He presented a rendering of the proposed buildings. <br /> <br /> No one in the audience spoke in opposition to the application or the negative <br /> declaration. <br /> <br /> There being no further testimony, Mayor Butler declared the public hearing closed <br /> on this item. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Wood, that <br /> Resolution No. 82-443, determining on the basis of a review of initial environmental <br /> study done for this project, that no significant environmental impact would occur as <br />~- outlined in the City's guidelines and that a negative declaration is appropriate for <br />F~. development plan approval for four light industrial/office buildings totalling 54,111 <br />~D sq. ft., and related facilities on a 3.7 acre site located on the northeast side of <br /> the Southern Pacific Transportation Company railroad tracks between Mohr Avenue and <br />[] Trenery Drive, be adopted. <br />m The roll call vote was as follows: <br />~[ AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br /> NOES: None <br /> ABSENT: None <br /> <br /> After discussion, it was moved by Councilmember Brandes, and seconded by Council- <br /> member Mercer, that Ordinance No. 1058, to be read by title only and waiving further <br /> reading thereof, approving the application of Devcon Construction Inc., for develop- <br /> ment plan approval for four light industrial/office buildings totalling 54,111 sq. ft., <br /> and related facilities on a 3.7 acre site located on the northeast side of the South- <br /> ern Pacific Transportation Company railroad tracks between Mohr Avenue and Trenery <br /> Drive, subject to conditions contained in Planning Commission Resolution No. 2238, be <br /> introduced. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br /> NOES: None <br /> ABSENT: None <br /> <br /> Application of Shell Oil Company to rezone approximately an 1.2 acre site located at <br /> the southeast corner of Hopyard Road and Johnson Drive from "C-F" (Commercial Freeway) <br /> District to the PUD (Planned Unit Development)-Commercial District and for development <br /> plan approval for a 2,830 sq. ft. service station facility including a convenience <br /> market and automatic car wash <br /> Mr. Harris presented his report (SR 82:449) dated November 1, 1982, regarding this <br /> matter. <br /> <br /> Mayor Butler declared the public hearing open on this item. <br /> <br /> Mr. Will Urban, representing Shell Oil Company, stated Shell is agreeable to all <br /> conditions as set forth in the staff report. <br /> <br /> Councilmember Mercer expressed concern regarding the signing program for the pro- <br /> ject. <br /> <br /> Councilmember Wood expressed concern regarding the sale of beer and wine at this <br /> establishment so near to the freeway. <br /> <br /> 7. 11/9/82 <br /> <br /> <br />
