287 <br /> <br /> Mr. Carl Cox, 2353 Saddleback Drive, Danville, future owner of the Shell Station, <br />stated he has three other services stations; one in Danville that is a service station <br />only, one in Dublin that is a service station and car wash, and one in Tracy that is a <br />service station and convenience market. He stated he has never had any problems in <br />the sale of beer and wine because of the professional type people he employs to operate <br />his stations. He stated he is willing to install signing as approved by the City. He <br />stated that many other places in the immediate area of his service station sell and <br />serve alcoholic beverages and he did not feel this issue should detract from his con- <br />venience market. He urged approval of this application. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> There being no further testimony, Mayor Butler declared the public hearing closed. <br /> <br /> Council discussion ensued regarding the width of the driveways, and the reasoning <br />for the Planning Commission to lessen the width from 44 ft. to 35 ft. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mohr, that <br />Ordinance No. 1059, to be read by title only and waiving further reading thereof, <br />approving the application of Shell Oil Company to rezone approximately an 1.2 acre <br />site located at the southeast corner of Hopyard Road and Johnson Drive from "C-F" <br />(Commercial Freeway) District to the PUD (Planned Unit Development)-Commercial Dis- <br />trict and for development plan approval for a 2,830 sq. ft. service station facility <br />including a convenience market and automatic car wash, subject to all conditions con- <br />tained in Planning Commission Resolution No. 2239, be introduced. <br /> <br /> Council further discussed the width of the driveways. Mr. Stan Roller, Engineer <br />representing Shell Oil Company, stated that their original plan proposed a 44 ft. wide <br />driveway because they felt it would make an easier entrance into and exit out of the <br />service station, but Planning Commission had reduced the width to 35 ft. He stated <br />that S~ell is willing to have either width. <br /> <br /> After discussion, Councilmember Brandes amended his motion to change Condition <br />No. i of Planning Commission Resolution No. 2239, that all three driveway approaches <br />shall be 44 ft. in width.
