He advised there was an amendment to be made to No. 9 of the agree- <br />ment relative to Sewer Capacity adding the sentence "the developer understands to <br />the extent sewer capacity becomes unavailable for some reason beyond the control <br />of the City of Pleasanton this guarantee is no longer'in effect". <br /> <br /> Mr. Sieglitz stated he did not want to have added the more generalized under- <br />standing. <br /> <br /> After discussion, Mayor Butler declared this item continued to the meeting of <br />November 9, 1982, for clarification of the wording in the agreement by all parties. <br /> <br />PUBLIC HEARINGS (Contd.) <br />Application of Harris Realty and Mildred Vallarino for Planned Unit Development (PUD) <br />development Rlan approval for an 88 multi-family unit complex on an approximately 4.7 <br />acre site located on the north side of Vineyard Avenue opposite Amador Court. Zoning <br />for the property is PUD (Planned Unit Development)-High Density Residential District <br /> <br />Consider adoption. of Negative Declaration <br /> Mr. Harris presented his report (SR 82:415) dated October 18, 1982, regarding this <br />matter. Mr. Harris advised that the applicant has amended his plan to include ten more <br />parking spaces.
