Mr. William Gale, Attorney representing Kamp, Kral and Crouch, stated he would <br />like the reports corrected to show that Kamp, Kral and Crouch are the property owners <br />and not the developers. He stated the developer (Castlewood Properties) has sub- <br />mitted a plan and that the staff recommendations make sense as this is a natural <br />progression of density for this area. Mr. Gale took exception to Condition 8 re- <br />garding the developer participation in the funding of a comprehensive water study <br />of the north Pleasanton area. He stated that if for any reason the developer did <br />not go ahead with his plans then this expense would fall back on the property owners, <br />who were not financially able to support this cost. Mr. Gale requested that Condi- <br />tion 8 be deleted. <br /> <br /> Discussion ensued between Council and staff concerning the effects of assessment <br />districts and other funding mechanisms upon property owners and developers. <br /> <br /> Mr. Gale reiterated the property owners had no opposition to the development plan <br />but would request that Condition 8 be deleted as far as the land owner is concerned. <br /> <br /> Mr. Art Dunkley, representing Castlewood Properties, Inc., 205 Main Street, and <br />proposed developer, reviewed the development plans relative to zoning and overall <br />planning. He stated he is only asking for conceptual plan approval so that this <br />property can be planned in an orderly process. He stated he concurred with Mr. Gale <br />in opposition to Condition 8. He read a letter previously sent to Council outlining <br />the reasons for this opposition. Mr. Dunkley stated he had contacted all residents <br />in the area by letter informing them of the proposed development plans and had held <br />meetings to further discuss the proposal. <br /> <br /> Council discussion ensued regarding the legality of the suggested assessment <br />district, who would be involved, and how property owners or developers could buy in <br />later on if not included in the original assessment district. <br /> <br /> Mr. Herb Singleton, 2207 Martin Avenue, spoke in opposition to this application <br />and stated he felt a systematic approach to the entire area should be taken by <br />Council before any decisions are made on any of the properties. He urged Council <br />to continue this item and any other proposals in the area until such time as a <br />comprehensive study can be done. Mr. Singleton stated he had not received notifi- <br />cation of all the materials and metters referred to by Mr. Dunkley, and he requested <br />to be put on the mailing list. <br /> <br /> Mr. Dunkley stated he had a list of 21 property owners and had tried to be sure <br />that everyone was properly notified. <br /> <br /> There being no further testimony, Mayor Butler declared the public hearing closed <br />on the application and the proposed negative delcaration. <br /> <br /> Council discussion ensued regarding further review of the entire Mohr-Martin <br />area. After discussion, Council determined to hold a special meeting as soon as <br />possible to study all aspects concerned with the subject properties. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Brandes, to <br />reopen the Public Hearing relative to the application of Castlewood Properties, Inc., <br />Everett and Dixie Kamp, Merle and Paul Kral and Helen Crouch for rezoning to allow <br />a phased mixed density residential project on approximately 58 acres of land located <br />at the northeast corner of Oakland and Mohr Avenue, and the accompanying negative <br />declaration, and to continue this item indefinitely to allow Council review of the <br />entire Mohr-Martin area at a special meeting, the date of which has not been deter- <br />mined at this time. <br /> <br /> 5. 8/10/82 <br /> <br /> <br />
