Mayor Butler Geclared the public hearing open on the application and the Mitigated <br />i~egative Declaration. <br /> <br /> Mr. John Ferreri, 865 Abbie Street, applicant, stated he concurred with the staff <br />report. He stated he had a concern regarding inclusion of this property within the <br />North Pleasanton Assessment District. Mr. Walker advised there will be a protest <br />public hearing in the spring relating to inclusion of properties in the Assessment <br />District and share of costs. Councilmember Mercer asked Mr. Ferreri if he had met <br />with the surrounding neighbors regarding this application. Mr. Ferreri advised he <br />had met with some of the people but had not met with each neighbor, stating he felt <br />it was better to wait until he had a specific plan to present to them for their review <br />and input. He stated that development of this property would be subject to all condi- <br />tions and demands of the previous PUD. <br /> <br /> Mr. Ed Roquette, 3436 Windsor Court, President of the Pleasanton Meadows Cabana <br />Club and Homeovmers Association, stated that to his knowledge there are no residents <br />who have objected to the change in zoning back to commercial; that opposition has been <br />to high density residential zoning. He asked that Pleasanton Meadows residents be <br />allowed input as to the quality of development proposed for this site. He stated he <br />felt that development of this property to commercial might alleviate some of the bur- <br />dens on the City of people having to travel to to~n for shopping; and that maybe this <br />project should receive some special consideration relative to inclusion in the assess- <br />ment district because of this fact. <br /> <br /> Mr. W. G. Kovac, 3124 Weymouth Court, stated he was not speaking in favor of or <br />against the application; his concern is for protection of the 11 neighbors whose pro- <br />perty abuts the proposed project. He stated he is not as concerned about what is <br />going to be developed as to how it is going to be developed. He stated that Mr. <br />Ferreri had not contacted him as he promised he would do at the Planning Commission <br />meeting. Mr. Kovac concluded by stating he did not want to lose any of the condi- <br />tions of approval attached to the original PUD. <br /> <br /> No one in the audience in opposition to the application. <br /> <br /> Mr. Ferreri stated it is his intention to meet with the neighbors when he has a <br />specific development plan to discuss with them, and that he did intend to adhere to <br />the conditions previously placed-on the PUD. <br /> <br /> There being no further testimony, Mayor Butler declared the public hearing closed <br />on the application and the mitigated negative declaration. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Wood, that <br />Resolution No. 83-540, determining on the basis of a review of initial environmental <br />study done for this project, that no significant environmental impact would occur as <br />outlined in the City's guidelines and that a mitigated negative declaration is appro- <br />priate to approve the application of John Ferreri and Fred Miranda to amend the <br />general plan land use designation on approximately 6 acres located at the southeast <br />corner of Santa Rita Road and West Las Positas Boulevard from High Density Residen- <br />tial to Commercial and Offices, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: None <br /> <br /> Considerable Council discussion ensued regarding the policy for properties to <br />be included in the North Pleasanton Assessment District boundary, and the benefits <br />this particular development would receive from the services of the assessment dis- <br />trict. Further discussion ensued regarding the total amount of the subject property <br /> <br /> 6. 12/6/83 <br /> <br /> <br />
