369' <br /> <br />Application of Capital Conveyance Company to amend the ~eneral plan land use designa- <br />tion on approximately 1.56 acres located on the north side of Valley Avenue just east <br />of the Homyard Shopping Village'from Public and Institutional to Commercial and <br />Offices <br /> <br />Consider Adomtion of Negative Declaration <br /> Mr. Harris presented his report (SR 83:557) dated November 30, 1983, regarding <br />this matter. <br /> <br /> Mayor Butler declared the public hearing open on the application and the negative <br />declaration. <br /> <br /> Mr. Michael Miklaus, President of Capital Conveyance Company, Sacramento, stated <br />he had met with neighbors regarding this request for rezoning. He reviewed the park- <br />ing situation, which he stated was adequate. He stated he plans to have retail type <br />stores on the first floor and office use on the second floor of the proposed develop- <br />ment. He stated that the total allowance for restaurant type use has been used up. <br />He added that the proposed development will act as a barrier to the homes on Longspur. <br />He strongly urged approval of the general plan amendment and stated he is willing to <br />work with the neighbors, city staff, and Council relative to the PUD plan. <br /> <br /> The following person spoke in opposition to this item: <br /> <br /> Mr. Don Mahoney, 2820 Longspur Way, stated that Council had previously zoned this <br />area Public and Institutional to act as a buffer to the homes on Longspur. He stated <br />he has concern regarding a build up of traffic to the bar in this Center, due to pro- <br />posed growth in the area, thus creating problems to the residences behind the Center. <br />He stated there is an overflow and shortage of parking at this time and that any addi- <br />tional development will create more parking problems. He stated his second concern <br />is that any further development and parking problems will adversely affect the value <br />of the property on Longspur Way. <br /> <br /> Mr. Miklaus rebutted by stating that with the proper Planned Unit Development <br />plan and design, that it will mitigate the concerns of the neighbors. He stated he <br />felt there is adequate parking at the Center. He added that he is willing to work <br />with the homeowners regarding parking and buffer measures. He advised that with the <br />current zoning it is difficult to lease space in the Center. He added that the PUD <br />restrictions would control all requirements necessary to mitigate the concerns of <br />the currounding neighbors. <br /> <br /> There being no further testimony, Mayor Butler declared the public hearing closed <br />on the application and the negative declaration. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Mohr, that <br />Resolution No. 83-546, determining on the basis of a review of initial environmental <br />study done for this project, that no significant environmental impact would occur as <br />outlined in the City's guidelines and that a negative declaration is appropriate to <br />approve the application of Capital Conveyance Company to amend the general plan land <br />use designation on approximately 1.56 acres located on the north side of Valley Avenue <br />just east of the Hopyard Shopping Village from Public and Institutional to Commercial <br />and Offices, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: None <br /> <br /> Councilmember Mercer stated he felt Council needs additional information regard- <br />ing parking, ingress and egress, and future development plans, before a decision can <br />be made on this item. <br /> 15. 12/6/83 <br /> <br /> <br />
