373 <br /> <br /> Mayor Butler declared the public hearing open on this item. <br /> <br /> Mr. Ted Fairfield, representing Foothill Builders, stated he concurs with the <br /> staff report. <br /> <br /> No one in the audience spoke in opposition to the item. <br /> <br /> There being no further testimony, Mayor Butler declared the public hearing <br /> closed. <br /> <br /> It was moved by Councilmember Wood, and seconded by Councilmember Mercer, that <br />Resolution No. 83-449, after finding that in accordance with Section 66472.1 of the <br />Government Code (Subdivision Map Act) that there are changes in circumstances which <br />make the condition of the 40 foot building setback line no longer necessary, and that <br />modification of said condition to 10 feet does not impose any additional burden on <br />the present fee owners of the properties affect, as indicated on Tract 4373, Parcel <br />Map 3529 and Parcel Map 2293, therefore approve the application of Foothill Builders <br />and DeWitt Wilson to modify a recorded condition of approval affecting a portion of <br />Subdivision Tract 4373, Parcel Map 3529 and Parcel Map 2293 to reduce an existing <br />building setback from the required 40 feet to 10 feet; and authorizing staff to <br />execute and record the appropriate certificates of correction as approved by the <br />City Attorney, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: None <br /> <br />Plans relating to site oreparation for construction of an approximately eight million <br />gallon water reservoir and related facilities to be located in the area westerly of <br />the intersection of Foothill Road and Stoneridge Drive <br /> <br />Consider Adoption of Mitigated Negative Declaration <br /> Mr. Warnick presented his report (SR 83:439) dated October 6, 1983, regarding this <br />matter. <br /> <br /> Mayor Butler declared the public hearing open on the application and the mitigated <br />negative declaration. <br /> <br /> No one in the audience spoke in favor of or in opposition to this item. <br /> <br /> Mayor Butler declared the public hearing closed. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Wood, that <br />Resolution No. 83-450, determining on the basis of a review of initial environmental <br />study done for this project, that no significant environmental impact would occur as <br />outlined in the City's guidelines and that a mitigated negative declaration is appro- <br />priate for site preparation for the construction of an approximately eight million <br />gallon water reservoir and related facilities to be located in the area westerly of <br />the intersection of Foothill Road and Stoneridge Drive, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: None <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mercer, that <br />Resolution No. 83-451, approving plans relating to site preparation for construction <br />of an approximately eight million gallon water reservoir and related facilities to be <br />located in the area westerly of the intersection of Foothill Road and Stoneridge <br /> <br /> 11. 10/11/83 <br /> <br /> <br />
