Mr. Dale Bo~.~an, 789 Bonita, stated that he had a complaint against Viacom Cable- <br />vision and would like to have something done to restrict R and X rated programs from <br />being shown on open channels. Councilmember~ Brandes stated that franchise negotia- <br />tions with Viacom will soon be underway, and that as a member of the Citizens Advisory <br />Committee he will see that Mr. Bo~anants complaint is made known. <br /> <br />PUBLIC HEARINGS <br />Appea~ by the City Council of a decision of the Design Review Board approving ~-83-148, <br />an application of Charles Chesterman for design review approval for the construation of <br />a four-unit studio apartment complex to be located behind the existin~ residence at <br />4834 Harrison Street. Zoning for the property isRM-1500 (Multi-family Residential) <br />District <br /> Mr. Harris presented his report (SR 83:407) dated September 21, 1983, regarding <br />this matter. <br /> <br /> Mayor Butler declared the public hearing open on this item. <br /> <br /> Mr. Charles Chesterman, 766 Emerson Court, Fremont, presented a brochure to <br />Council that he had personally distributed to each of the neighbors who had signed <br />a petition opposing the proposed project. The brochure explained the details of the <br />project. He stated that he had not received any phone calls relative to the plan. <br /> <br /> MS. Jocelyn Combs, 4857 Harrison Street, stated she has worked with Mr. Chester- <br />man on this project. She stated that in the beginning she had some concerns about <br />noise and traffic but these concerns have been mitigated. She stated that as a member <br />of the General Plan Review Committee she is aware of the need for multi-unit rentals <br />in the City, and she felt this project would be an asset to the community. <br /> <br /> Ms. Victoria Graham, 367 Bernal Avenue, whose property abuts the rear property <br />line of the proposed project, spoke in opposition to the proposal. She referred to <br />the petition presented previously outlining the concerns of the residents of the area. <br />She stated she felt the project would be another tacky development in our residential <br />community, and that it is not in the best interest of the neighbors because it will <br />create too many people and vehicles in a small area. She stated she opposes the <br />height of the proposed structure as it will invade her privacy. She urged Council <br />not to approve construction of the project. <br /> <br /> Mr. Chesterman stated the area is zoned for this type of project, that rental <br />housing is a critical need in the city, and he felt there was not as much opposition <br />to the project as originally stated, therefore he felt approval of the development <br />was in order. <br /> <br /> There being no further testimony, Mayor Butler declared the public hearing closed. <br /> <br /> After discussion, it was moved by Councilmember Brandes, and seconded by Council- <br />member Mercer, that Resolution No. 83-415, denying the appeal of the City Council, and <br />approving Z-83-148, an application of Charles Chesterman for design review approval <br />for the construction of a four-unit studio apartment complex to be located behind the <br />existing residence at 4834 Harrison Street, subject to all conditions contained in <br />Design Review Board Resolution No. R-83-20, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: None <br /> <br /> 5. 9/27/83 <br /> <br /> <br />
