193 <br /> <br /> Develepment Deferment Agreement with Mozart Development Company and Stoneson <br /> Development Company <br /> Mr. MacDonald stated the agreement has not been received therefore he would <br />request a continuance of the item to the meeting of September 27, 1983. <br /> <br /> Mr. Joe Burkhardt, representing Daon and Stoneson Corporations, stated he was <br />unable to provide the necessary information for the agreement and asked for a con- <br />tinuance of this matter-. <br /> <br /> Mayor Butler declared this item continued to the meeting of September 27, 1983. <br /> <br /> Councilmember Mercer stated he was concerned that the Daon parcel has a condi- <br />tion that traffic levels of service not fall below C level while other developments <br />in the assessment district have a level D requirement. Mr. Harris advised that the <br />Meyer Center also has the condition of level C LOS. <br /> <br /> After discussion, it was moved by Councilmember Mercer, and seconded by Council- <br />member Brandes, initiating an amendment to Ordinance No. 973, Meyer Center, and to <br />Ordinance No. 1014, Daon Corporation, changing the condition to allow for level D <br />traffic levels of service instead of level C. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, and Mayor Butler <br />NOES: None <br />ABSENT: Councilmember Wood <br /> <br />Request for Low Income Exemption for Shelter CapitaA Pro3ect <br />Mr. MacDonald presented his report (SR 83:374) dated September 6, 1983, regarding <br />this matter. <br /> <br /> Mr. Joe Simmons, 77 Jordan Avenue, San Francisco, stated there is a need for <br />rental housing of this quality and feels the project meets city requirements for the <br />exemption. Mr. Simmons requested that low income units be so restricted for only <br />ten years, rather than the twenty-five year period specified in Section l(a)(iii) <br />of the Gro~rth Management Procedures and Guidelines. <br /> <br /> Council discussion ensued regarding HUD requirements. Mr. MacDonald stated he <br />would like to see the HUD documentation. <br /> <br /> Councilmember Brandes asked why the subject report had been prepared by the City <br />Attorney without recommendations from the City Manager and Planning Commission. <br /> <br /> It was moved by Councilmember Brandes to get recommendations from the City Manager <br />and Planning Commission before making a decision on this item. <br /> <br /> The motion died for lack of a second. <br /> <br /> Councilmember Mercer cited a portion of the report that read "On the other hand, <br />casing the low income exemption requirement could lead to a dramatic increase of <br />applications for the low income exemption. This may crowd out more desirable market <br />rate projects or increase pressure to change residential gro~ch rate limitations". <br />Councilmember Mercer stated he felt Shelter Capital is a well designed project and a <br />desirable project. Mr. MacDonald stated he was trying to set forth both arguments <br />and was not ~aking a recommendation. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Mayor Butler, approving <br />the low income exemption for the Shelter Capital project with the four recommenda- <br />tions contained in Staff Report 83:374. <br /> <br /> 9. 9/13/83 <br /> <br /> <br />
