191 <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmember Mercer and Mayor Butler <br /> NOES: Councilmembers Brandes and Mohr <br /> ABSENT: Councilmember Wood <br /> <br /> Councilmember Brandes stated he could not support lowering the time requirement <br />on the low income set aside because it would be asking for a change to the Growth <br />Management policy; if people feel the need for a change it should go back for staff <br />report and review by the Planning Commission. He added that if the people felt <br />the need for a low income set aside, then it should remain as such for a sufficient <br />period of time, preferably the 25 years, not a short time of ten years. <br /> <br /> After further discussion, it was moved by Councilmember Mohr, and seconded by <br />Councilmember Mercer, that Resolution No. 83-394, approving the low income exemption <br />for the Shelter Capital Project, after making the following policy determinations: <br />(1) amend Section l(a)(iii) of the Growth Management Program Guidelines and Procedures <br />to reduce the time limit restriction on low income units from 25 years to 15 years; <br />(2) approve the proposed low income exemption requested for Shelter Capital project; <br />and (3) authorize the City Attorney to draft and the Mayor to execute a contract to <br />run with the land on the Shelter Capital project to insure that the low income re- <br />strictions are effectively implemented, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Mercer, Mohr, and Mayor Butler <br />NOES: Councilmember Brandes <br />ABSENT: Councilmember Wood <br /> <br />Amendment to Pleasan.ton.~wera~e Code to Establish Maximum Flow Limitation <br /> Mr. MacDonald presented the report of the Assistant City Attorney (S~ 83:384) <br />dated September 6, 1983, regarding this matter. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Brandes, that <br />Ordinance No. 1101, to be read by title only and waiving further reading thereof, <br />amending Chapter 8 (Sewerage Code) of Title II of the Ordinance Code of the City of <br />Pleasanton by adding Section 2-15.30.01(c), maximum permissible discharge, be intro- <br />duced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, and Mayor Butler <br />NOES: None <br />ABSENT: Councilmember Wood <br /> <br />COMMUNICATIONS <br />Letter from James H.. Price~ Alderwood Associates <br /> Mayor Butler presented a letter from James H. Price, Alderwood Associates, dated <br />September 6, 1983, protesting taxing of new home sales under the Business License Tax <br />imposed in 1983. <br /> <br /> Councilmember Brandes stated that the City of San Jose has hired Ralph Andersen <br />and Associates of Sacramento, to conduct a study and make recommendations relative <br />to their business license tax, and perhaps the City could get some pertinent infor- <br />mation from this study. <br /> <br /> After further discussion regarding the business license ordinance, Council took <br />no action relative to the letter from Mr. Price. <br /> <br />CITY COUNCIL CALENDAR <br /> Mr. Walker presented the City Council Calendar for the information of the <br />Council. <br /> <br /> 10. 9/13/83 ~ <br /> <br /> <br />
