'93 <br /> <br />Appeal of Pizza Time Theatre, Inc.~ of a decision of the Design Review Board denying <br />their application. to retain an illegal wall sign on the Chuck E. Cheese Pizza Time <br />Theatre located at 5572 Springdale Drive. The property is zoned C-R(P) (Re~ionaI <br />Commercial, Periferal) District <br /> Mr. Harris presented his report (SR 83:320) dated August 1, 1983, regarding this <br />matter. <br /> <br /> Mayor Butler declared the public hearing open on this item. <br /> <br /> Mr. Skip Hall, District Director for Chuck E. Cheese, stated that signing is <br />necessary from an economic standpoint, otherwise the public is not-aware of this <br />business location. <br /> <br /> Mr. Ed Barkley, representing Buck Stoves, also located in the Best Plaza, stated <br />there is a great need for advertisement by signing and felt it is important for <br />businesses to be allowed to do so. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> Councilmember Mohr stated she felt this is a matter that should be settled be- <br />tween the landlord and the tenant, not by City Council. Mr. Harris advised that <br />the property manager for Stoneridge Center has submitted a new signing program for <br />the Center. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Wood, that <br />Resolution No. 83-343, denying the appeal of Pizza Time Theatre, Inc., of a decision <br />of the Design Review Board denying their application to retain an illegal wall sign <br />on the Chuck E. Cheese Pizza Time Theatre located at 5572 Springdale Drive., and in- <br />structing the applicant to remove the sign and repair the building immediately, be <br />adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: Councilmember Mercer <br /> <br />Appeal by the City Coun.cil of a decision of the Plannin5 Commission approval of the <br />application of Ch~is Beratlis for conditional use permit approval to operate a 940 <br />s~. ft. "take-out" restaurant at 929-B Main Street. Zoning for the property is C-C <br />(Central Commercial) District <br /> Mr. Harris presented his report (SR 83:322) dated August 1, 1983, regarding this <br />matter. <br /> <br /> Mayor Butler declared the public hearing open on this item. <br /> <br /> Mr. Rich Spot, One Valley Drive, Orinda, tenant for the proposed restaurant, <br />stated he operates two other restaurants; one in Oakland and one in Castro Valley. <br />He stated this application meets the city requirement relative to parking. He stated <br />the concern regarding loitering and littering should not be a problem because of the <br />type of restaurant planned for this location. Mr. Spot presented seven letters from <br />surrounding property owners of his other two restaurants, supporting Mr. Spot and his <br />business. He requested that condition No. 2 - "that this use permit shall be reviewed <br />by the Planning Commission within one year" - be deleted as it is detrimental to <br />financing for the proposed development. <br /> <br /> Council discussion ensued regarding parking. Councilmember Mohr suggested that <br />use of the veterinary clinic parking lot in the evenings be discussed with that owner. <br /> <br /> 6. 8/9/83 <br /> <br /> <br />
