137

MEETING OPEN TO THE PUBLIC
Mrs. Juanita Bianchi, 4105 Walnut Drive, requested that the petition listed under
Communications on the agenda, be considered at this time, regarding noise control at
the Nuclear Laundry. Mayor Butler stated that since the item is listed on the agenda
it should not be considered at this time. After discussion, Council agreed to con-
sider the item at the conclusion of Meeting Open to the Public on the agenda.

Mr. Harold Dixon, 4066 Suffolk Way, asked if the joint meeting between the City
Council and Planning Commission will be open to the public, in compliance with the
Brown Act. Mayor Butler advised that this meeting will be an open meeting to the
public and stated that the meeting has been properly noticed. Mr. Dixon stated that
there have been inaccuracies in the City Council and Planning Commission minutes re-
lative to comments made by the public. He asked if the minutes are certified before
being permanently recorded. The City Attorney advised that the minutes are drafted by
the secretary, edited by the City Attorney and City Manager, then typed in final form
by the secretary for approval by the City Council, and are subject to correction by
Council or anyone desiring to make corrections that are deemed necessary for proper
recording. He also advised that each public meeting is taped and that these tapes
are kept as the permanent verbatim record, and these records are also available to
anyone desiring to refer to them.

Mr. Steve Hughes, 587 Touriga Court, asked if the $50,000 from Holiday Inns was
accepted as a gift before voting on their application at the previous meeting. Mayor
Butler advised that the $50,000 was a condition of approval; that Holiday Inns is not
a part of the North Pleasanton Assessment District and it was felt they should pay
their fair share to the fire district since they would be received the same protec-
tion as those participating in the assessment district, and that the money would be
used for equipment to put the fire station into operation.

COMMUNICATIONS
Petition from Property Owners in area adjacent to Nuclear Laundry at 65 Ray Street
Mrs. Juanita Bianchi, 4105 Walnut Drive, stated that a petition had been presented
to Council, dated June 22, 1983, signed by 29 residents on Walnut Drive, which read as
follows:

"The following property owners living in the area adjacent to the Nuclear Laundry,
Interstate Nuclear Services, located at 65 Ray Street, Pleasanton, are concerned
and protesting the noise created by this laundry. It is suggested that the City
of Pleasanton make it's own survey of the facility and determine the environmental
problems created by this installation. A response to our concerns as soon as
possible will be much appreciated".

The City Attorney advised that he has met several times with Mr. Connolly of the
Nuclear Laundry, as well as state and county health officials. He stated that al-
though the Nuclear Laundry is not in violation to the CityTs noise ordinance, Mr.
Connolly is inclined to cooperate but does not want to spend a lot of money. Mr.
Connolly is looking into three specific items to correct the sound problem and will
advise the City of the results of these actions within 30-45 days. Mrs. Bianchi
stated she felt the surrounding property owners had not been properly notified of
this City Council meeting, or the actions taken by the City Attorney. Mayor Butler
advised that only land use and zoning matters require written notification. After
discussion, Mayor Butler instructed staff to write a letter to the surrounding pro-
perty owners advising them of future actions taken relative to the Nuclear Laundry
noise problem, and to notify them if this matter is 'again considered on the Council
agenda.

4. 7/26/83
