It was moved by Councilmember Mercer, and seconded by Councilmember Wood, that <br />Resolution No. 83-274, approving the plans relating to construction on Valley Avenue, <br />between Hansen Drive and the Arroyo del Valle, consisting of roadway widening, land- <br />scaping, utilities installation, and other related improvements, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: None <br /> <br />MATTERS CONTINUED FOR DECISION <br />Adoption of Ordinance No. 1089 amending the business license and gross receipts tax <br />schedule and modifying other pprtions of the businesslicense and gross receipts <br />tax ordinance <br />~Intro. 6-14-83, 3-Ayes, 1-No, 1-Absent) <br />'(Contd. from 6-28-83) <br /> Mayor Butler stated that Ordinance No. 1089 was introduced on June 14, 1983, by <br />a vote of 3-Ayes, 1-No, 1-Absent, had been continued from the meeting of June 28, 1983, <br />and that it was now in order to adopt the ordinance. <br /> <br /> Ms. Debra Strong, Executive Manager of the Chamber of Commerce, reiterated the <br />position of the Chamber in support of the business license tax increase, but asked <br />that it be a reasonable increase. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Wood, that <br />Ordinance No. 1089 amending the business license and gross receipts tax schedule and <br />modifying other portions of the business license and gross receipts tax ordinance, <br />be adopted. <br /> <br /> Mayor Butler stated he has no problem with the recommendation to change the fee <br />structure but felt there is some legitimate concern about the method of implementing <br />the fee structtme. He stated the ordinance could be placed in effect at this time <br />but implement it in some manner that would allow a budget cycle for a business to <br />allow for the sharply increased fees. He stated this could be modified later if the <br />city finds that state revenues are not forthcoming as presently anticipated when the <br />state budget is adopted. <br /> <br /> It was moved by Councilmember Mohr, and seconded by Mayor Butler, to amend the <br />motion for adoption of Ordinance No. 1089, to add a Section 2 to read "In order to <br />mitigate the short term effects of this license increase on businesses which formerly <br />benefitted from the $250 cap and to allow reasonable time for businesses to budget <br />for this license increase, the above tax schedule shall be phased in for the 1983-84 <br />fiscal year only as follows: for businesses with gross receipts of $250,000 and above <br />the rate shall be $0.15/$1,000 of gross receipts or $75, whichever is greater". <br />The roll call vote was as follows: <br />AYES: Councilmember Mohr and Mayor Butler <br />NOES: Councilmembers Brandes, Mercer, and Wood <br />ABSENT: None <br /> <br /> Council discussion ensued regarding enforcement of the ordinance. Ms. Wagner <br />advised that an accountant will be hired effective January 1, 1984, to implement the <br />system and follow up on collection of the business license fees. Discussion also <br />ensued regarding the fee structure. <br /> <br /> There being no further discussion, Mayor Butler called for the vote on adoption <br />of Ordinance No. 1089. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Wood, and Mayor Butler <br />NOES: Councilmembers Mercer and Mohr <br />ABSENT: None <br /> 7. 7/12/83 <br /> <br /> <br />
