289 <br /> <br /> It was moved by Councilmember Wood, and seconded by Councilmember Brandes, that <br />Resolution No. 83-257, after making the necessary findings: (a) that because of special <br />circumstances applicable to the property, including size, shape, topography, location <br />or surroundings, the strict application of the provisions of this chapter deprives such <br />property of privileges enjoyed by other properties in the vicinity and under identical <br />zoning classification; (b) that the granting of the variance will not constitute a <br />grant of special privilege inconsistent with the limitation on other properties clas- <br />sified in the same zoning district; and (c) that the granting of the variance will not <br />be detrimental to the public health, safety, or welfare, or materially injurious to <br />properties or improvements in the vicinity, therefore City Council approves the appeal <br />of Ralph and Pearl Goold of a decision of the Board of Adjustment denying their appli- <br />cation for a variance to allow the construction of an accessory building which would <br />encroach into the required side yard of the property located at 3651 Zwissig Court, <br />subject to the following conditions: (1) that the design of the accessory structure <br />shall match the residence both in color and architectural style; (2) that the acces- <br />sory structure shall be set back from the front of the house at least eight feet; and <br />(3) that this variance is granted to Mr. Goold as the owner of the property and does <br />not run with the land, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, Wood, and Vice Mayor Mercer <br />NOES: None <br />ABSENT: Mayor Butler <br /> <br />Adoption of Fiscal Year 1983-84 Budget and Three Year Capital Improvement Program <br /> Mr. Walker presented the report of the Director of Finance' (SR 83:234) dated <br />June 15, 1983, regarding this matter. <br /> <br /> Vice Mayor Mercer declared the public hearing open. <br /> <br /> Mr. George Moore, 5517 Paseo Nayafro, addressed the Council requesting that the <br />street lights be turned on that were de-energized with the passage of Proposition 13. <br /> <br /> There being no further testimony, Vice Mayor Mercer declared the public hearing <br />closed on this item. <br /> <br /> Mr. Walker stated that PG&E has advised him of a new rate schedule which will <br />reduce the estimated cost of turning on all lights, more than first anticipated. <br /> <br /> After discussion, it was moved by Vice Mayor Mercer, and seconded by Councilmember <br />Mohr, to turn on all street lights ~hat were de-energized with the passage of Proposi- <br />tion 13 and to pay for all lights that are now being paid for by private citizens, and <br />to cover this expense from the general fund. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, Wood, and Vice Mayor Mercer <br />NOES: None <br />ABSENT: Mayor Butler <br /> <br /> Mr. Warnick advised that it will take approximately six months to have all the <br />lights turned back on. <br /> <br /> Vice Mayor Mercer stated he had some concerns relative to the budget; he felt <br />the City Manager had not been given an opportunity to state his recommendations, <br />only Department Heads had done so at the recently held budget session. He stated <br />that after talking with the City Manager he had a problem justifying the police clerks, <br />and felt the park maintenance program should be expanded. <br /> <br /> Councilmember Brandes stated he felt a priority list should be established as to <br />projects that might come up and as money becomes available. <br /> <br /> 8. 6/28/83 <br /> <br /> <br />
