291 <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Wood, that <br />Resolution No. 83-255, determining on the basis of a review of initial environmental <br />study done for this project, that no significant environmental impact would occur as <br />outlined in the City's guidelines and that a negative declaration is appropriate for <br />design review approval to allow the construction of an approximately 32,000 sq. ft. <br />industrial park building and related facilities on an approximately 86,000 sq. ft. <br />site at 2142 and 2150 Rheem Drive, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, Wood, and Vice Mayor Mercer <br />NOES: None <br />ABSENT: Mayor Butler <br /> <br /> It was moved by Councilmember Wood, and seconded by Vice Mayor Mercer, that <br />Resolution No. 83-256, approving the application of Devcon Construction, Inc., for <br />design review approval to allow the construction of an approximately 32,000 sq. ft. <br />industrial park building and related facilities on an approximately 86,000 sq. ft. <br />site at 2142 and 2150 Rheem Drive, subject to all conditions contained in Planning <br />Commission Resolution No. 2316, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, Wood, and Vice Mayor Mercer <br />NOES: None <br />ABSENT: Mayor Butler <br /> <br />Appeal of Ra!Dh and Pearl Goold of a decision of the Board of Adjustment denying <br />their application for a variance to allow the construction of an accessory building <br />'U~ich would encroach into the required side yard of pro2erty located at 3651 Zwissi~ <br />Court. The pr.operty is zoned R-1-6500 District <br /> Mr. Harris presented his report (SR 83:247) dated June 21, 1983, regarding this <br />matter. <br /> <br /> Vice Mayor Mercer declared the public hearing open on this item. <br /> <br /> Mr. Ralph Goold, 3651 Zwissig Court, stated he felt he has a just and legitimate <br />cause to construct a canopy in his side yard to protect his motor home. He stated he <br />had purchased the large lot with this in mind. He advised there are two 40" gates <br />into his back yard and that this would allow any necessary emergency access. He <br />stated there was no opposition from the surrounding neighbors. He concluded by <br />stating he felt he is entitled to the variance. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> There being no further testimony, Vice Mayor Mercer declared the public hearing <br />closed. <br /> <br /> Councilmember Wood requested Mr. Harris to read the findings necessary for approval <br />of variances. Mr. Harris read the findings, and stated it is his opinion that neces- <br />sary findings could not be determined for two of the three findings (special circum- <br />stances and special privilege), but that the third finding (not detrimental to sur- <br />rounding properties) could be made. <br /> <br /> Councilmember Wood stated he had personally look at the lot in question and that <br />the size of the lot and adaptibi!ity to use for parking a motor home without adversely <br />affecting surrounding properties constituted special circumstances and that this would <br />not constitute a special privilege so that the variance should be granted. Council- <br />member Brandes stated he had investigated this matter on-site and concurred with <br />Councilmember Wood. <br /> <br /> 7, 6/28/83 <br /> <br /> <br />
