Adoption of Resolution No. 83-207, after review of bids, award contract for
Nuisance Abatement for 1983 to Spilker Tree Service, Inc., in the amount of
$28.16 per hour.

q. Adoption of Resolution No. 83-208, approving termination of November 22, 1971
agreement between Ponderosa Homes and City of Pleasanton relative to Hansen/Mix
property.

The roll call vote was as follows:
AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler
NOES: None
ABSENT: None

MATTERS INITIATED BY COUNCILMEMBERS
Councilmember Mercer stated that a notice had been received from the Alameda
County Planning Department regarding modification of Surface Mining Permit, SMP-9,
Ormond/Moller Quarry, which will increase the number of loaded trucks permitted to
exit the site from 200 to 240 on any one day. After discussion, it was moved by
Councilme~ber Mercer, and seconded by Councilmember Wood, directing that a letter
be transmitted to the Alameda County Planning Department reiterating the City's
opposition to any further increase in truck traffic, and further stating that the
City's Supervisor had assured that there would not be any increase in the number
of loads, and that this is the second modification being applied for an increase.
The roll call vote was as follows:
AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler
NOES: None
ABSENT: None

Councilmember Mercer read his statement regarding the General Plan Steering
Committee appointment of Larry Osborne as follows:

"I have discussed my feelings and my reasons for making the statements
surrounding the political nature of Larry Osborne~s appointment to the
Steering Committee of the General Plan Review Committee with several of
the Steering Committee members as well as many of the General Plan Review
Committee members. It is obvious that an explanation will help clarify
the misunderstandings.

"My statements were misunderstood by Mr. Innes and Mr. Weidel, who in
my opinion over-reacted and then went on to accuse the City Council, and
me particularly, of appointing an individual who would bring dishonesty
and a "developers" approach to the Steering Committee. I don't feel any
of the Councilmembers, especially myself, is trying to be dishonest with
the General Plan Committee members.

"The following statement should clarify Mr. Innes' misunderstandings.

'My statements surrounding the *political fiasco~ involved in the
General Plan Review deal with the involvement of C.B.G., not the
citizens of Pleasanton! C.B.G. is an out-of-town group who solicited
money from Pleasanton citizens, then sued the City to stop our
development, and finally settled out-of-court with the builders. In

my opinion they were using the General Plan Review as a forum to
further their political aims. I object to that] The City Council
did not invision a political forum when it formulated the General
Plan Review, nor when it gave the Steering Committee it's charges in
setting the Review in motion.

3. 5/24/83
